How can you use policy analysis to improve criminal justice outcomes?

I disagree with the position that the first step of policy analysis is to define the problem you’re seeking to address in the CJS. I think identifying the challenges that exist, specifying how they adversely impact diverse groups of people, and narrowing your advocacy interests is the first step. You cannot analyze policy for diverse circumstances and experiences you don’t understand or aren’t aware of. And you’re not going to feel compelled or have the time to invest in the exploration of every advocacy issue. Then, determining which laws, policies, and practices govern those areas of concern should be the next step. Figuring out how they became relevant, how they can be modified, and analyzing the language that is used to apply them.

I’ve found it useful to decide on your policy network as a useful first step. You need to know who is interested in the issue including their definition of the problem and the source of interest. This way, you gain insight on the complexity of the issue and a sense of the contesting views. For example, is drug abuse a criminal issue or a health issue? Do you strengthen prosecution or rehabilitation or find a balance? As part of your network analysis, you’ll need to have a clear sense of your authorising environment by answering the questions “What do the decision makers (could be public or elected officials) perceive as a valuable outcome; what have I included/excluded and is such exclusion/inclusion justified?”

Policy analysis is often flawed, but well intentioned. In my opinion, rather than focus strictly on policy, it is important to first start with the crime and determine its prevalence. For example, if its "petty theft" those cases more often than not have either a mental health or a drug addiction component. If you start with the crime and focus on its causes then you can move towards correcting the problem. The drawback of policy analysis is that it tries to cast a wide net for multiple problems, but most crimes have very basic underlying issues.

I would start with observing the trends. When observing operations and what policies are in place tells you how things have been going and what I actually effective. The starting point has to be how you got here and what you want it to look like. What changes need to happen? What are you looking to improve? Do you want to bring in support services or add staff? Do you what to improve staff performance through training? Policy has the ability to make an agency evolve towards progress. Finding a sustainable solution builds a long term plan that provides confidence to staff and improved deliverables.

The ideologies of the different actors are very important when proposing policies, especially with various approaches being put on the table.

Based on my own observations, Equity refers to the concept of attaining equal results, even if it involves using uneven treatment, biased competition, and preferential judgment, which is unattainable in practice, such as under socialist systems.

The first criteria in measuring a policy is the outcome we are trying to achieve. At the same time, we must consider if the policy protects the rights of all individuals regardless of race, color, gender, creed or socio-economic status. Does the policy focus on behaviors or identity? Also, can the policy, as imagined, be applied consistently?

In 2024, when we look at criminal justice policy, our first measure is effectiveness. We're asking: does this policy do what it's supposed to do? Reduce crime, lower recidivism? Then, it's about being data-driven, ensuring our decisions are based on hard evidence, not just opinions. We also need to think about public trust. Are these policies building a bridge between law enforcement and the community? Feasibility is key too; can we actually implement these ideas? And let's not forget adaptability - our world's changing fast, and our policies need to keep up. This is how effective policy is found.

After policy, comes education and awareness - than comes the criteria and the measurement of success. If people are not aware there will be no interest and hence we will be no results.

Public opinion does not always line up with medical and legal counsel. Also, the public is not united on moral correctness. This makes standards of effectiveness subjective and not objective. The huge assumption that values are universally shared, which they don’t seem to be for a wide segment of society.

Equality refers to the principle that the law and government should treat all individuals equally, regardless of their social standing or personal characteristics. Equity refers to the concept that, in some situations, individuals must be treated differently to provide a fair and substantial level of equal opportunities. The United States has effectively rejected Marxist efforts to deviate it from its longstanding trajectory of freedom and stability. Nevertheless, American Marxists have acquired more power than ever before, capitalizing on the complacency that winning typically engenders.

As we consider alternatives, we must be careful to understand how they will be implemented and enforced. We also need to try to research similar policies in other circumstances and why they failed or succeeded.

In policy analysis, especially in criminal justice, generating multiple alternatives is crucial. It broadens our view, ensuring we don't miss more effective solutions. This approach sparks innovation, essential in a complex field like this. With several options, we can compare and contrast, making more informed decisions. It also respects diverse stakeholder needs, improving policy acceptability. Plus, it's a safety net—if one solution fails, we have others to turn to. And importantly, it helps us use our resources wisely, choosing options that deliver the best results for the investment.

La generación de políticas que funcionen como alternativas es un ejercicio que debe repetirse cuantas veces sea necesario. Having alternative is good. But all alternative plans/policies doesn't work for us. We need to understand under what circumstances the alternative policies are made. keeping all aspects in mind we should proceed further.

This approach assumes a stagnant crime problem waiting to be solved. Crime unfortunately does not work that way, it is forever a moving target. Considering that policy advocates are typically politicians and often ignore stakeholders, views of the public are also required.

In my opinion, under the guise of social justice, Marxists are now attempting to undermine the fundamental principles of the American Republic by revising historical accounts, reinstating racial discrimination, establishing favored groups, and imposing restrictions on public discussions, the military, and places of worship. If Marxist doctrine is not effectively countered, contemporary cultural Marxists will succeed in accomplishing what the Soviet Union failed to achieve: the complete domination of the United States by a totalitarian and spiritually devastating philosophy.

Evaluate alternatives in terms of their expected outcomes; the cost of implementation; and the ability to change the policy if results are undesirable.

If Marxist ideas are not overcome, its advocates will want to impose a totalitarian worldview on the United States, eradicating both freedom and opportunity.

The first priority when developing policy regarding crime must be the protection of victims. This must be first and forefront when selling your policy recommendation to those in a position to enact it. The next priority must be the cost effectiveness of implementation. The third priority must be measurement with a demonstration of how that is built into and funded together with implementation.

You can communicate the results but unless they are relatable the data won’t mean anything to the intended recipient. It’s important to connect the recipient with the messenger by finding commonality between the two.

I agree that the subsequent phase of policy analysis entails proposing the optimal option that fulfills your criteria and effectively resolves the issue or attains the objective. In order to substantiate your advice, it is essential that you provide explicit and persuasive information and reasons that bolster your selection. Marx had a theory of politics to some extent, but his idea of governance was very limited. The term "the capitalist state functions as the administrative body of the bourgeoisie" encapsulates the most basic interpretation of his perspective on the state. He often saw government and law as a manifestation of class interests.

Es tal vez la parte más importante y la más desafiante para los creadores de políticas, poner al escrutinio público los hallazgos en el diseño de las políticas. Convencer a los stakeholders y tomadores de decisiones que el paso diseñado es el correcto es tan importante como identificar el problema en un inicio. Seems like we live in an era of excessive information and low trust. The problem is, a low trust environment creates roadblocks for policies that could be game changing. Seems like not enough energy and attention is being given to rebuilding trust within our local communities and then expanding outwards from there.

The goal of policy analysis in criminal justice is to identify what is working well, and what areas are ripe for change. While identifying the problems and using robust research methods to address solutions, we cannot forget the importance of interviewing stakeholders and people directly impacted by a particular policy. Look at any data points that can surface issues. And lastly, before executing any policy change, ensure that no unintended consequences can result causing additional harm to those you are trying to help.

Get rid of prisons! Horrible places. In 1971 Sweden had camp like prisons. A much better example and not dehumanizing like in America.

These changes and recommendations can manifest in many forms such as legislative changes, adjustments to law enforcement procedures, or implementation of rehabilitation programs. In doing so, we can further identify areas of improvement within the criminal justice system and work toward creating a more just and efficient system overall.

This article sustain an idealist and outdated conception of policy analysis as a linear process of clarifying problems and chosing between solution alternatives, under the premisse of rational and orderly assessment of evidence. But the policy process is much, much more disornained, ambiguous and driven by irrational motives. All of which already have a significant body of scientific knowledge about it, enough to discart recomendations based on this linear oversimplification.

Policy means having objective, identify successful areas and improvement areas. We should regularly interview stakeholders, data research, and marketing feedback to ensure that changes do not result in unintended consequences
