What do you do if you're unsure how to handle a difficult employee situation as an entry-level HR Consultant?

In my HR career and starting as a freelancer, I have found that other people in the space are more than willing to discuss complex problems. HR is not always straight forward and often requires having another person to bounce ideas off of. Whether you reach out to another consultant, a previous manager, or connect with someone on LinkedIn, there is someone out there that will help you work through the problem.

If your organization is partnered with a PEO, this should be a layup - this is literally the reason that SMBs like to partner with PEOs. Since PEOs can deploy a deep set of resources, they are able to help the SMB navigate these issues quite effectively.

Effective communication is pivotal in managing workplace situations. By actively listening, diligently taking notes, and consulting with senior management as needed, you can navigate these circumstances proficiently. It is important to recognize that handling numerous scenarios throughout the year will enhance your resilience and reduce stress over time, equipping you to perform consistently under various pressures.

You should first consider, what the organization's policies say about such a situation, what the labour laws say and finally the most humane way to handle the situation. Seeking advice is also advisable.

In my experience having someone you can trust for support and advice in your early career is vital. It doesn't always have to be someone in HR, you can easily get advice on how to handle a difficult situation (without breaching confidentiality) from another trusted member of the business. I leveraged a number of other places for advice early in my career including CIPD helpline, ACAS and lots of online resources. Sometimes this is your only option in a standalone role.

One thing to remember is not to be rushed. Making sure you gather all the information is critical. Some managers will rush you OR apply pressure. I don't believe they do it for any other reason than they're busy people and want to get it resolved in a timely manner. Reassure them that taking a bit extra time to get all the facts and review all the details is important to ensure it's handled correctly.

Make sure you have all the data points - there are often 2 sides to every story. Be sure to document everything! And be proactive - a pinch of proactivity is worth a pound of cure.

A technique I have employed is to approach the subject with the employee by stating that I have something sensitive to discuss with them and asking them to meet with me in a private place where we won't be disturbed. Then, I would get straight to the point., while expressing myself as compassionately as possible. If the purpose of the discussion is to notify them of some adverse action due to their failure to improve, such as placing them on a performance improvement plan or terminating their employment, it's important to convey that the decision has already been made and is not open for negotiation. In this case, it may be helpful to have a third party present.

Feedback without clear "next steps" is a waste of time for everyone. Give the employee quantifiable objectives and timelines to hit, and make sure they understand it is against these metrics that they will be measured and held accountable for.
