India has a complex legal framework, hence The compliance manager plays a crucial role as he has to ensure that the organization complies with all relevant laws applicable to them which includes Government (Central & State) defined labor laws, tax regulations, environmental norms, and industry-specific rules to ensure corporate governance at all times. The compliance manager has to create Policies and procedures and Audit them on a regular basis to ensure its aligned with various government acts and legal requirements.

The Compliance manger should be the person in the organisations that “translates” legal, regulatory and standard compliance requirements into actual business practices. Aside from what's stated, Compliance Officers are also expected to have soft skills, we are also expected to have good bed side manners like Doctors and ask the right questions to make the correct diagnosis and find the symptoms and it's source of cure. Only difference is we don't wear the white coat!

Depending on what risks you aim to mitigate (security, data privacy, fraud, sanctions etc.), a legal, technical, financial or business background is helpful (ideally combined together and with industry experience). My personal focus is also to: - have a long-term (& holistic) vision of how the program shall work (as you are also co-building a company's culture) - be structured & well organised (as you maintain a framework that should operate as a whole) - consistent & fact based (to demonstrate a documented program and alignment to internal rules and requirements when needed) - be an effective collaborator & communicator (as you commonly interact with other teams and need to understand how they work and what issues are facing).

Compliance officers often start in non compliance roles and slowly gain exposure to Compliance issues. Then they apply to and start Compliance/Compliance related roles. Outside of the long standing experience route. Professional degrees like Law and Accountancy are seen as the best options for a career in Compliance. Professional Qualifications such as those offered by the ICA or the CISI are also popular with graduates and non grads alike.

The perception issue is still a problem. Compliance is not often taken as seriously as it should - generally across organisations. This is human nature. The desire to get away with doing wrong. Consequently, they are not often very popular with Front Business teams. A visit from Compliance already suggests that something could be going wrong. Ethics is not Compliance. It could be more ethical.

In my years of experience a compliance manager should be in addition to the various qualifications be a subject matter expert in the area of compliance and always be updated on key changes as well as regulatory requirements to be relevant in the ever changing world.
