To navigate variances by local authorities in a global commercial leasing deal, start by thoroughly researching and understanding the local zoning laws, building codes, and leasing regulations for each jurisdiction involved. Engage local legal and real estate experts to ensure compliance with these variances and identify any potential roadblocks early. Maintain open communication with local authorities to clarify specific requirements or seek approvals for exceptions. Building strong relationships with these authorities can also help smooth the process. Additionally, incorporating flexible lease clauses that account for potential regulatory changes can safeguard the deal against future disruptions.

Based on my experience, every area in my country has its own unique purchasing preferences and limits. An expert much be able to engage and understand the demographics and the habits of the clientele they are serving. It requires patience and keen attention to how to address the needs of the surrounding community while maintaining a non-invasive approach that would not cause disturbance. I do not have a flowchart or a workflow to illustrate that but this has been my style since day one. Though I am tempted to elaborate further when time permits.

In the U.S., variances are governed (1) by state law first and (2) then by local ordinances. State law must authorize local governments to grant variances, and any local ordinances pertaining to variances must be in accordance with the state authorization. One thing to keep in mind is the difference between "use" variances (which authorize a relaxation of the use restrictions relevant to the property) and "area" variances (which authorize a relaxation of development standards like setbacks, height requirements, etc.). The legal standard form obtaining use variances typically is more onerous, and in some states, use variances aren't allowed at all.

The first step is to find the rules. Knowing why you need a variance is fundamental. Second, why would you approve a variance if you were the authority? My experience is a pre-luminary meeting or phone call typically works best. I find most people want to help. They just need to know that no one is going to fire them for giving the variance. Show the benefit to the decision maker (often in development, the taxing authority wants improved property tax amount rather than what they are getting). Be prepared to give something of value so that you get a yes.
