Access Now defends and extends the digital rights of people and communities at risk. As a grassroots-to-global organization, we partner with local actors to bring a human rights agenda to the use, development, and governance of digital technologies, and to intervene where technologies adversely impact our human rights. The US District Court of Northern California just handed WhatsApp a major win in the case against #NSOGroup! 🎉 ⚖️ NSO was found liable under federal #CFAA & California state law (CDAFA) for #Pegasus hacking through WhatsApp's servers. The court also found that NSO breached the contract with WhatsApp by violating their Terms of Service. Since the court found NSO liable, all that remains to be decided at trial is how much should NSO pay to WhatsApp - the damages. The trial is scheduled to begin on March 3, 2025 at 8:30am in Oakland, CA. While this lawsuit is only between WhastApp and NSO, it promises to have a big impact on other cases brought against spyware companies. And it validates so many victims' experiences. We at Access Now & partners with the help from Kyle McLorg at Farella Braun + Martel LLP submitted amicus brief during the 9th Circuit appeal stage. Our brief featured testimonies of courageous #Pegasus targets from #Morocco, #India, #Rwanda & #Togo. This win also belongs to them & other Pegasus victims. The wheels of justice are slow, but the period of impunity for spyware purveyors and abusers is winding down and I believe they will face justice for undermining our security and human rights. As the holiday season approaches, we’re calling on UK Prime Minister Keir Starmer and Foreign Secretary David Lammy to act decisively in securing the release of Alaa Abd el-Fattah, a British-Egyptian writer and technologist who has been unjustly detained in Egypt since 2019. Alaa’s mother, Laila Soueif, also a British citizen, has been on hunger strike for over 80 days, demanding the UK government’s intervention to secure her son’s freedom. Today, the Freedom Online Coalition (FOC) has issued a Joint Statement on the Future of the Multistakeholder Approach at the United Nations. The statement, endorsed by all 42 FOC Members, reaffirms the necessity of multistakeholder collaboration, including between governments, civil society, the private sector, international organizations, media, the technical and academic communities, and further advocates for the development and use of digital technologies in ways that respect human rights and the rule of law, support democracy, promote inclusive governance, and accelerate progress on the Sustainable Development Goals. The Coalition's Member States renew their commitment to inclusive, bottom-up and open multistakeholder approaches to the governance of digital technologies and to sustained, meaningful dialogue and engagement with all stakeholders to share knowledge and expertise, at all levels.
