28,000 gross square feet. That is the average size of a Big Lots location. The company currently has approximately 1,300 locations. Recently, the company conducted planned closures. But doubts about its ability to survive as a going concern raise #bankruptcy prospects. In chapter 11 the company would have the power to reject leases rapidly under the Bankruptcy Code. Alternatively, the company could sell these leases. For landlords a #BigLots bankruptcy filing would mean either: (I) a vacancy to fill; or (II) a new tenant who purchases the lease in the case. #chapter11 #realestate #distressedsale

Another victory for BMULZ on a bogus claim for a real estate commission by a broker who had no agreement with anyone yet wanted $565K. They sued everyone and their grandmother and got zero. The Third District Court of Appeal affirmed the prior summary judgment we obtained in our clients' favor.

Initially, the debtor selects which #bankruptcy chapter it files. For businesses, this is primarily Ch. 7 or 11. But once a bankruptcy is filed creditors and other parties in interest can seek conversion of a case to a different chapter. Here, the US Trustee (a component of the DOJ) moved to convert the case from Chapter 11 to Chapter 7. For a debtor the move from Chapter 11 to 7 means losing control as the assets are turned over to Ch. 7 trustee to liquidate. For creditors, the ability to request conversion levels the playing field in negotiations with the debtor. And motivates most debtors to operate appropriately while in bankruptcy. #chapter11 #chapter7 https://lnkd.in/ez69hN9f
