The Complaint for Blake Lively from Manatt, Phelps & Phillips, LLP and Willkie Farr & Gallagher LLP shows how much complaints have evolved in the social media era. Nowadays you see screenshots of iPhone faces, collages of screenshots, and elaborate graphs reflecting changing sentiment. More visuals than pages. #legalwriting

I posted something similar on Twitter/X and got some good questions about hallucinations. If you want to verify cases and the like, try Perplexity. It provides hyperlinks to sources. For the draft brief described below, I simply copied and pasted the brief and used this prompt: "Can you verify the integrity of each of the cases cited here and share an online source for each one?" Perplexity confirmed each case and provided footnote-like references hyperlinking to the actual cases: The table provided in the search results contains the verification and online sources for each of the facts and cases cited in the amicus brief. You may reference this table for the requested information. It includes the case names, verification status, and source URLs for each cited case. All the cases listed in the table have been verified as true, and each entry includes a corresponding online source where you can find more information about the specific case or fact. This table serves as a reliable reference for confirming the integrity of the legal citations used in the amicus brief argument. For lawyers and law students, is ChatGPT really just "a C+ student that can pass the bar exam?" I'll report; you decide. An interesting new law review article cites the tale of Suffolk University Law School Dean Andrew Perlman asking ChatGPT to draft a brief and getting lousy results—back in 2022 (screenshot #1) Now it's almost 2025. I just tried the same prompt with ChatGPT o1 pro mode and got back something quite different (screenshot excerpt #2 and #3) Much better, though not great. But then I added just one sentence to that earlier prompt: "Can you flesh out a longer and more nuanced brief with more citations?" A few seconds later, I received a full brief (screenshot excerpt #4): Link to the full brief in comments. Impressive. But then I did one more thing. I started a new chat and asked it to review the draft brief for inaccuracies or misleading claims. Pretty strong analysis in the comments. Bottom line: It took me more time to write this post than to generate a draft SCOTUS brief and have it critiqued. There's some denial across our profession, particularly in academia, when it comes to GenAI. To reach the best decisions for your career, make sure you're armed with the latest info on its true capabilities! #legaltech #legalwriting #legalinnovation

Can we all agree on something when it comes to President Trump's new lawsuit over the Iowa poll? Beware of fully justifying your margins (the formatting type, not the polling type) if you include a URL! #legalwriting #appellatetwitter

How will AI transform the practice of law and the legal profession? How will it affect employment opportunities for attorneys? What changes will it bring to legal education and the training of young lawyers? I tackled all of these topics in the latest episode of the Original Jurisdiction podcast, in conversation with Ross Guberman. One of the nation’s leading authorities on legal writing, Ross has conducted thousands of writing workshops and has written two authoritative books on the topic, Point Made: How to Write Like the Nation’s Top Advocates and Point Taken: How to Write Like the World’s Greatest Judges. Ross’s most recent venture is BriefCatch, a legal-tech startup that produces an amazing writing and editing tool of the same name. It harnesses the power of technology, including AI, to help lawyers produce their very best written work product. And as Ross revealed in our conversation, BriefCatch has used AI to address one of legal writing’s most annoying aspects: Bluebooking, i.e., adherence to the copious, complex, confusing conventions for citing authorities of different types. If you hate The Bluebook, then you’ll love this forthcoming addition to BriefCatch. Thanks to Ross for joining me, and thanks to NexFirm for sponsoring. The next episode of the podcast will appear in January.
