The U.S. PTO is eyeing even more applicant-unfriendly fee increases. While attempting to target large public company filers with even more fees, such increases harm investment in innovation in the U.S., and also significantly impact and discourage filing by smaller private corporations and mid-sized entities that while large enough to qualify for large entity status have difficulty budgeting ever-increasing fees while still rebuilding from the impact of the pandemic. The increases are to help cover costs of examination created by multiple filings, but it is also trying to push against specific filing strategies in order to discourage multiple filings. However, multiple filings are necessariy the result of an unduly narrow restriction practice in the U.S. which causes complex inventions with multiple aspects to almost always be split and not always in a logical manner. Many of these restrictions are necessary but are for Examiner search convenience, but clearly it is such restrictions that primarily drive multiple filings. Discouraging multiple filings by outsized fees discourages protection of all aspects of innovation losing such aspects in the process due to cost instead of commercial merit. Take a closer look at these fees and inventors and applicants as well as practitioners still have the ability to comment on the proposed fees before they are formalized.
