#AnnualFees #Trademarks #Caribbean #TurksAndCaicos #CaymanIslands Dear Colleagues, This is friendly a reminder that the deadlines for annual fees for trademark registrations in both Turks & Caicos Islands and Cayman Islands are upon us. The annual fees for all registered trademarks in the Cayman Islands are due between January 1 and March 31 each year. If annual fees are not paid by March 31, financial penalties accrue and rights are deemed in abeyance. Turks & Caicos fees are due between January 1 and February 1. There is no late fee for paying after February 1, but rights are deemed in abeyance until fees are paid. Fees can be paid for multiple years in advance. We recommend attending to payment of all annual fees as early as possible so that rights are in good standing and enforceable. #28Jurisdictions #OneStopShop #Caribbean #IP #Trademarks #IPRightsProtection For #Aruba, an autonomous country within the Kingdom of the Netherlands, trademark applications were initially filed with the Bureau of Intellectual Property of the Netherlands Antilles established in Curaçao. Since November 1987, Aruban trademark applications are filed with the Bureau of Intellectual Property of Aruba (BIPA). Aruba’s trademark filing and registration process is one of the more efficient and straightforward in the Caribbean, and unlike some regional counterparts, it permits applications for service marks and multi-class applications. However, while marks are examined on relative grounds, trademark practitioners and brand owners should be aware that Aruba does not provide for opposition proceedings at the administrative level. Rather, applications deemed problematic must be monitored and cancelled post-registration. Brand holders should budget for additional enforcement costs in Aruba accordingly. More recently, standalone national filings have become widely available. One such Caribbean country where national filings are relatively recently available is #AntiguaAndBarbuda, where an overhaul by virtue of the Trade Marks Act 2003 removed the possibility to re-register UK rights. Of note, this country was the first English-speaking jurisdiction in the Caribbean to provide for trademark registration via the #MadridProtocol, while the relevant law also allows for service marks and multi-class applications. Last weekend, we delivered the second ambulance that Brand Action donated through BEforUkraine - a moment made even more special by the personal connections driving this journey. This time, Taras Kulbaba, representing Brand Action and deeply connected to the cause, took the wheel alongside Patrick Hely, one of our incredible sponsors. To complete this important mission, Mariana Ryviuk Rydel arrived in Poland to help Patrick drive the last leg across the border. Starting in Vilvoorde, we followed a route similar to the first delivery in September, covering hundreds of kilometers over three days: Day 1 to Görlitz (880 km), Day 2 to Rzeszów (590 km), and finally Day 3 into Lviv (170 km). As we rolled into the Lviv National Opera Plaza, the warmth and gratitude of the local community were palpable once again. This delivery felt profoundly personal for everyone involved. It is not just about delivering aid; it’s about bringing hope and reminds us why we do this. To all who made this possible - our sponsors, supporters, and volunteers -you’re part of something much larger than this delivery. Together, we’re proving that when people unite across borders, we can leave this world a better place.
