  • Recently, our team enjoyed celebrating the holiday season with two of our favorite annual events. To start celebrations off, we gathered at Sidecar Social for a festive holiday party, enjoying great company, arcade games, and an overall fun atmosphere! We continued the celebrations with a firm-wide White Elephant gift exchange filled with laughter and surprises. A perfect way to close out the year together!     As a new member of the Family Office Club, I  was delighted to attend the Super Summit in Miami last week - an incredible gathering of over 750 attendees.  It was a great time to connect with investors and entrepreneurs. A highlight of the event was engaging with former tech founders who are now managing their own family office funds and who are passionate about giving back and helping the next generation of entrepreneurs succeed.    As a technology and AI lawyer, it was great to see all the focus on AI.  Family offices are eager to explore investments in this transformative sector.  Vincent Allen and I saw a lot of enthusiasm for the future of AI and innovation to come.   #CAGLaw #AITriageCenter

    Is it ok to publish AI-generated fake news and attribute it to real papers? I was recently featured in a WIRED article discussing a lawsuit against Perplexity. While the case brings attention to critical issues around AI-generated "hallucinations" and misattribution, the claims of false designation of origin and trademark dilution probably will not stand. The Supreme Court in Dastar found that even where content is copied, the “origin” of the work is whoever created it.  In this case, it will likely be found that Perplexity created the physical goods in question, even if some of the text was improperly attributed to a real newspaper.     I recently had the opportunity to share my thoughts in Fortune about a critical question in the social media influencers: Who owns your X or Meta accounts?  For example, if you build up a substantial following, are you able to sell the account? The Terms of Service govern but can be vague over the basic question of ownership.  For X, the Terms of Service clearly reference “your account” in contrast to access to “X’s services.”  This implies that you own your account.  But when you ask Grok, the AI tool provided by X, about ownership, it will explain that a nuanced reading tells it that X owns the account. This raises significant questions for individuals and businesses alike: Are you really in control of your digital assets? Understanding platform terms is no longer optional—it's essential to protect your intellectual property and digital rights. This discrepancy highlights the importance of understanding the agreements we accept when using digital platforms. Whether you're a creator, a business owner, or a tech innovator, knowing your rights is critical in today’s AI-driven world.
