On November 8, the DOL Wage and Hour Division published an opinion letter in which the DOL reminded employers that “only the actual or reasonably approximate amount of the expense is excludable from the regular rate.” DOL found that an increase from $25 per day to $150 to $200 per day to reimburse employees for purchasing tools and the use of their personal phones and computers for work was not a reasonable approximation. This opinion letter is a valuable reminder that calculating the “regular rate of pay” is significantly more difficult than just looking at the employee’s hourly rate of pay.
