Based in our Sacramento office, Ivy has extensive experience representing and advising airlines and their insurers in connection with all aspects of commercial disputes, civil litigation, appeals, and regulatory compliance, including personal injury cases involving airlines, manufacturers, and their insurers in federal and state courts. From our New York office, practicing in both federal and state courts, Tom has experience in all areas of aviation litigation, representing airlines in both personal injury and commercial disputes, and most recently representing insurers in major coverage dispute litigation.   • Alongside experienced representatives from airlines, ground handlers, airports, and the aviation/aerospace insurance markets, Bart Banino participated in the IATA Standard Ground Handling Agreement (SGHA) Industry Meeting in Geneva, Switzerland from December 16-17. IATA organized the meeting with the objective of gathering input and feedback from all stakeholders as to the benefits and flaws with Article 8 of the SGHA, which covers liability and indemnity between airlines and ground handlers, and whether the current version continues to be relevant and balanced for parties. During the meeting, Bart presented legal issues and questions relating to the existing IATA SGHA and outlined some of the implications of changing or amending the current SGHA. #AviationLaw #AviationLitigation #IATA #SGHA

  • Montreal Convention Limits of Liability to Rise by 17.9%. Formally known as the Convention for the Unification of Certain Rules for International Carriage by Air, the Montreal Convention of 1999 establishes for airlines the liability limits for death, bodily injury, delays, baggage, and cargo issues. Last revised in 2019, these liability limits are reviewed every five years by ICAO and are indicated in Special Drawing Rights (SDRs), a unit of account defined by the International Monetary Fund. ICAO has notified 140 Member States to the Convention that liability limits will increase on 28 December 2024 by 17.9%.   • Condon & Forsyth welcomes Safa Chowdhury, Esq. to our Miami office. Safa is a graduate of the University of Miami School of Law. Her practice will focus on all aspects of aviation and commercial litigation matters, including the representation of foreign air carriers and their insurers in cases involving personal injury, wrongful death, aircraft ground accidents, and loss. Safa was awarded the Dean’s Merit Scholarship and the Priscilla Jewett Schneller Scholarship. During law school she worked as a student attorney at the Miami Law Startup Practicum, working directly with entrepreneurs on intellectual property, business formation, and corporate structuring.     I was proud to represent Condon & Forsyth LLP along with Andrew Johnson and Lisa Heller at the ABA TIPS Aviation and Aerospace Law Conference. I participated in a panel presentation "Recent Developments in Aviation and Space Law," along with Emma Hildebrand and Taylor Sandella. We covered a range of important topics, including personal jurisdiction under the Montreal Convention, field preemption, the Federal Tort Claims Act, and Chevron. It was an honor to engage with leaders in the aviation industry, and I look forward to attending this outstanding event again in the future. Kudos to the Committee for organizing such a fantastic and engaging event!
