Happy 2025! Excited to chat about the most complex problems in the business of law with Emery Wager. Looking forward to sharing what we've learned speaking to law firms about their billing models over the past year, and to share my thoughts on how properly linked up data can help make this process much easier.

If your law firm struggles with poor cash flow and low profitability, you’re not alone. A common culprit is failing to collect payment for work you’ve already performed. When clients fall behind on bills or pay sporadically, you’re left chasing payments instead of focusing on delivering high-quality services. This creates a ripple effect that undermines your profitability, strains client relationships, and disrupts day-to-day operations. One billing model designed to address this challenge is the evergreen retainer model. What Is the Evergreen Retainer Billing Model? The evergreen retainer is a billing arrangement where a client provides an upfront retainer that must be replenished once the client's balance drops below a certain threshold. For example, a client might provide an initial $10,000 retainer. As your firm performs work and invoices against the retainer, the client is required to replenish it whenever the balance falls below, say, $3,000. This ensures that your firm always has a sufficient reserve of funds to cover ongoing work. Send us message or add a comment if you'd like to implement evergreen retainers at your firm. We've got a ton of resources to help.

It’s collections season for many law firms. It's the time of year when firms realize they've become a bank for their clients. To honor the season, I recently sat down with Matt Darner of CollBox to hear his secrets for collecting. Matt and his team are on the front lines, making the calls, sending the emails, and helping law firms collect. He lives this problem every day and has some great tips using the 🥕, not the ⚔️ (couldn't find a stick emoji). Sharing the highlights here. We live in a world of high expectations. Clients expect ease, transparency, and responsiveness like never before, and those expectations aren’t going away. Meeting clients where they are is essential for growth. But here’s a key takeaway for your firm: you need to value your work enough to charge what it’s worth. It’s common to see attorneys with big hearts lower their prices to help more people. While well-intentioned, this approach often leads to burnout or financial struggles, preventing you from serving clients effectively over the long haul. ✅ Experiment with transparent pricing. ✅ Test new payment processes to see what works best for you and your clients. ✅ Build a sustainable model that allows you to do your best work—without sacrificing your well-being. The goal isn’t just to make ends meet but to create a practice that serves you while enabling you to serve others better.
