More Corporate Transparency Act flip-flopping....... In yet another court order concerning the Corporate Transparency Act (CTA), on December 26, 2024 the appellate court reversed its December 23rd ruling and reinstated the nationwide preliminary injunction staying enforcement of the CTA's reporting requirement. While the CTA is not currently able to be enforced, the court reiterates in its order that this issue remains under an expedited appeal, and that this issue will be briefed and ruled upon again in the near future. Late on Dec. 23rd, the Fifth Circuit Court of Appeals granted a stay over the injunction issued by the U.S. District Court for the Eastern District of Texas earlier this month. As such, corporations, including community associations, are again required to complete their beneficial ownership information filing under the Corporate Transparency Act (CTA). The Chicago City Council has adopted amendments to the recently passed Northwest Housing Preservation Ordinance. Among the changes are that the ordinance's enforcement now sunsets on December 31, 2029; sellers are now permitted to obtain waivers of tenants' rights of first refusal ("ROFR"); and, in buildings with 5 or more units, once 50% or more of tenants waive their ROFR the right is deemed waived.
