    Canadian Immigration Update from ESDC Re High Wage LMIAs and Business Legitimacy Requirements: 💲Higher Wage requirement : Starting November 8, 2024, the minimum wage for high-wage stream workers will increase by 20%, raising the threshold by $5 to $8 per hour, depending on the province or territory. New Business Legitimacy Rules: From October 28, 2024, employers can no longer use attestations from accountants or lawyers to prove business legitimacy, tightening compliance and ensuring stronger worker protections. Data Sharing: Enhanced cooperation with provincial and territorial partners to prevent misuse and ensure genuine job offers.     More Canadian Immigration Changes Expected Ahead! 🇨🇦 Get ready for potential adjustments in the high-wage stream for LMIA temporary foreign workers. Reports suggest a 20% increase above the provincial median hourly wage may be required, possibly effective as soon as November 8, 2024.   • Canada Tightens Work Permits in a Low-Wage Work Permit Stream KEY: This announcement does not impact all work permits, and is focused on low-wage positions that require advertising and a test of the labour market. This post is limited to changes to the "Temporary Foreign Worker Program" NOTE: HIGH-Wage review is coming up in the next 90 days. This may include changes to the Global Talent Stream LMIAs 🛑 What Do You Need to Know Starting September 26, 2024, the following changes will apply specifically to the Low-Wage Stream of the TFW Program: 1) No LMIAs for Low-Wage Stream in areas where the unemployment rate is 6% or higher. ➤ Exceptions: food security, construction, and healthcare. 2) Employers can hire a maximum of 10% of their workforce through the TFW Program, down from earlier limits. ➤ Exceptions: Seasonal and non-seasonal jobs in food security sectors (primary agriculture, food processing and fish processing), as well as healthcare and construction 3) Employment duration for Low-Wage TFWs will be reduced to one year. Currently: two years RATIONALE: Other than the obvious political play, the government is focusing on reducing Canada's unemployment rate of 6.4% and reducing a misuse of the program. What is the TFWP? The Temporary Foreign Worker Program (TFWP) requires a test of the labour market (i.e. advertising) or, in unique circumstances, a Labour Market Benefits Plan (i.e. a measurable commitment by an employer to support the Canadian labour market). Labour Market Impact Assessments (LMIAs) to ensure that hiring foreign workers does not negatively impact the domestic labour market.   • Update on Canada's Temporary Foreign Worker Program WHAT TO KNOW: Canada is about to tighten the Temporary Foreign Worker Program, which governs the Labour Market Impact Assessment (LMIA) work permit application process. WHAT IS THE LMIA? LMIA-based work permits fall under the Temporary Foreign Worker Program, which is one of the major work permit programs in Canada. It is one of the more onerous processes because it requires either a test of the Canadian labour market or a concrete plan to benefit the local labour market. WHAT TO KNOW: So far, we only have suggestions. However, Employers should nevertheless pay attention to Minister Randy Boissonnault's rhetoric. The Minister emphasized Canada's commitment to ensuring that the program be used only to fill critical labour shortages without displacing Canadian talent. Key actions will include: 1️⃣ Changes to the 20% cap policy This cap does not apply to all LMIA categories. The cap aims to limit the proportion of temporary foreign workers an employer can hire relative to their total workforce, ensuring that the program is not used as a primary staffing solution. It applies to certain sectors and geographic areas and includes stricter guidelines for those using the “dual intent sub-stream” (where a foreign national worker intends to apply for permanent residency). 2️⃣ Introducing stricter oversight and inspections in high-risk areas. While this is not new, we are seeing more inquiries and compliance reviews. The number of compliance reviews have have slowly, but steadily become more frequent. 3️⃣ Considering fee increases to fund enhanced program integrity measures. The government filing fees are already fairly high, but the program doesn't seem to have the resources to adequately tackle abuses. 4️⃣ Exploring regulatory changes to uphold employer eligibility standards. We may be seeing changes to employer eligibility factors (including a minimum number of years of business operations or a history of lay-offs by the employer) WHERE IS THIS COMING FROM? There continues to be WIDE-SPREAD abuse of this program. LMIA support in exchange for 10,000s of dollars is unfortunately common. WHAT'S NEXT: This announcement signals potential tightening restrictions for an already onerous application process. Employers should prepare for more stringent regulations and increased scrutiny, highlighting the importance of compliance and understanding the evolving requirements of the TFW Program. The Global Talent Stream is a special subset, and, while not expressly mentioned, this application process is not immune to scrutiny. Stay tuned! #TFWProgram #Canada #ImmigrationNews

    **Canadian Citizenship Law Changes Ahead** What is Changing? Ottawa is drafting a bill to reinstate citizenship rights for children of Canadian citizens born outside Canada. The Globe and Mail reports that the bill is expected to introduce a substantial ties test. First-generation Canadian citizens who obtained citizenship by descent (as children born abroad to Canadian parents) will be required to demonstrate a strong connection to Canada to pass on citizenship to their children who are also born outside Canada. Current Rules Limit Citizenship by Descent Currently, the law is straightforward for the first-generation born abroad but becomes murkier for the second-generation born abroad. April 2009 amendments to Canada's Citizenship Act limited automatic citizenship rights to the first-generation children of Canadian parents born abroad in most cases. The Harper government introduced the amendments to curtail "Canadians of convenience" by disallowing automatic citizenship rights for most children born abroad to Canadian parents (who were also born outside Canada). Why is the Law Changing? The 2009 amendments had unintended consequences. For example, the amendments impacted Canadians working or travelling abroad for short periods, who were unable to pass on their citizenship. This resulted in families being divided and individuals left stateless. Recently, the Ontario Superior Court of Justice ruled in September that denying citizenship to Canadians born abroad who wished to pass on their citizenship to their foreign-born offspring violated the Charter of Rights and Freedoms. The Federal Government has until June 19 to introduce new legislation.
