Delighted to be invited onto the Masters of Privacy podcast to discuss the latest proposal for a federal privacy law, the American Privacy Rights Act. We discuss some of the unique aspects of the proposal, some comparisons to the previous attempts and the GDPR, and some of the unique elements that have been added in an attempt to get this measure through Congress. [EN] An updated version of the proposed American Privacy Rights Act was published last week, ahead of a markup in the US House of Representatives. There were clarifications on the use of personal data in #DigitalAdvertising, amongst other things. But the core dilemmas remain: Does the inclusion of both a private right of action and a general preemption of overlapping state laws condemn the #APRA to the fire? Preemption is not limited to privacy (#CCPA, #BIPA #MyHealthMyData, #Vermont’s…) but could also encompass AI-related laws (#Colorado!). A private right of action could prove very tricky given how hard we are finding it to agree on what a “privacy harm” actually is (ask Daniel Solove and Ryan Calo).
