The U.S. Food and Drug Administration has announced a proposed rule aimed at establishing standardized testing methodologies to detect asbestos fibers within talc used in cosmetics products. The rule, which was mandated by the Modernization of Cosmetic Regulation Act of 2022, would require manufacturers to test cosmetics products containing talc for the presence of asbestos using Polarized Light Microscopy (“PLM”) (with dispersion staining) and Transmission Electron Microscopy (“TEM”)/Energy Dispersive Spectroscopy (“EDS”)/Selected Area Electron Diffraction (“SAED.” Foley Mansfield Partner Michael E.
