On October 7, 2024, the U.S. Supreme Court declined to review a decision in U.S. ex rel. Hart v. McKesson, clarifying the federal Anti-Kickback Statute. The Court reinforced that, to be held liable under AKS, there must be actual knowledge that an action is unlawful — not just awareness that it might be improper. This decision narrows the definition of "willfulness" and guides health care providers in managing AKS risks. A Texas federal court vacated the Department of Labor's 2024 rule that would have raised the salary threshold for EAP exemptions under FLSA. This means no increase to $844/week in July 2024 or $1,128/week in January 2025. The threshold returns to $684/week. The DEA and HHS announced a third extension of COVID-era telemedicine flexibilities, allowing practitioners to prescribe certain controlled substances via telemedicine through December 31, 2025.
