Started to receive inquiries about this exciting news for J-1 exchange visitors so I wanted to briefly explain the change here. The U.S. Department of State has revised the Exchange Visitor Skills List for the first time since 2009. This change will impact many J-1 visa holders by removing the two-year home residency requirement for individuals from countries that are no longer listed, including India, China, Brazil, and Turkey. The two-year rule can be a significant hurdle for J-1 visa holders, often preventing them from applying for H-1B visas or permanent residency without returning to their home country or obtaining a waiver. With this update, if your country is no longer on the Skills List, you will not be subject to the two-year home residency requirement based on the Skills List. This applies retroactively, so it may affect those who were previously subject under the previous Skills List. But here is the important part: this change does NOT apply to everyone. The two-year rule still applies if: (1) Your J-1 program involved U.S. or foreign government funding. (2) You participated in graduate medical training in the U.S. (residency or fellowship).

🎉 On June 18, 2024, the Biden Administration's Department of Homeland Security (DHS) took a monumental step towards family unity with the new program called Keeping Families Together! This program will allow certain noncitizen spouses and stepchildren of U.S. citizens to apply for parole in place, potentially enabling them to seek lawful permanent residence without leaving the U.S. 🌟 This is a game-changer for countless families who have been living in the shadows for years. 🌟 Here’s what you need to know: ✅ Eligibility: Noncitizen spouses of U.S. citizens who have been in the U.S. for 10+ years, have no disqualifying criminal history, and meet other requirements. Stepchildren of U.S. citizens are also eligible. Last month I was elected to begin a five-year term on the Executive Committee for the Minnesota-Dakotas Chapter of the American Immigration Lawyers Association. I am particularly looking forward to serving this year on ExComm with two of my law school sectionmates, Jesse Goldfarb and Tim Sanders Szabo, along with our colleagues Matthew Webster and Maria Miller. Tim and I headed to Chicago last week for the AILA Annual National Conference. The conference is a wonderful opportunity to meet and learn from colleagues practicing U.S. immigration law all over the world. We also had the opportunity to hear directly from government officials — including U.S. Citizenship and Immigration Services Director, Ur Jaddou, pictured here. Thanks to my colleagues and staff at Karam Law for supporting me in this new adventure on ExComm. I am excited to get to work!
