#Huawei and #CCP #EB5 Denials Through FOIA litigation in collaboration with American Immigrant Investor Alliance, we have learned more about USCIS's blanket denials of EB-5 cases involving funds sourced from Huawei--the world's largest telecommunications company. The documents include an email from the Government Accountability Office (GAO)—a Congressional watchdog—seeking an #IPO report titled "Employment by Huawei is Sufficient Basis for [National Security] Concern." While we don't yet have the report, its title speaks for itself. The GAO also references a "pilot process of referring all petitions with source of investment funds from Huawei positions to a single senior adjudicator." This, too, explains USCIS's copy-and-paste boilerplate denials on I-829 petitions (and presumably I-526/Es) where the funds were sourced from #Huawei. While disheartening, this highlights the need for investors to mount strong responses to Huawei-related NOIDs and denials to build the strongest record possible on these cases, including the use of experts. Finally, the email also references a policy document titled "[Chinese Communist Party] Inadmissibility and Fraud." This helps explain another recent trend we have seen of USCIS raising issues about CCP membership (and other admissibility issues) in I-829 petitions. The I-829 is not supposed to be a forum for adjudication of admissibility, yet the #IPO has (unlawfully) transformed it into one. Given the increasing tensions between the United States and China, this trend of enhanced scrutiny on EB-5 cases for Chinese investors is unlikely to go away anytime soon. Investors must hold the #IPO to account for the rights and protections that the law guarantees.
