Receiving a cease and desist letter can be stressful, but your response (or lack of one) can determine what happens next. If ignored, these letters often lead to lawsuits, even if the claims are baseless. One of our clients—an influencer just starting out—received a letter from a much bigger creator, demanding that he stop making similar content or face legal action. Instead of backing down, he came to us. After reviewing the claims, we responded, showing that the accusations had no merit and that our client actually had grounds to take legal action against them for abuse of process and malicious prosecution. The key takeaway? Don’t assume a cease and desist letter means you have to comply.
