𝘾𝙇𝙄𝙀𝙉𝙏 𝘼𝙇𝙀𝙍𝙏: New York’s top court has upheld the constitutionality of the Commission on Ethics and Lobbying in Government (COELIG), ensuring its continued authority over ethics and lobbying enforcement. In a 4-3 decision, the Court of Appeals reversed lower court rulings that questioned COELIG’s structure, siding against former Governor Andrew Cuomo’s challenge. With this ruling, COELIG remains intact and can proceed with pending matters, including its investigation into the $5.1M book deal involving the former governor. On February 14, 2025, the President signed an Executive Order that bars federal funds from being used to support or subsidize an educational service agency, state education agency, local education agency, elementary school, secondary school, or institution of higher education that requires students to have received a COVID-19 vaccination to attend in-person education programs. While neither the Secretary of Health and Human Services nor the Secretary of Education has issued any guideline regarding the implementation of this Executive Order, public commentary and some client inquiries indicate there is some confusion regarding the scope of last Friday's Executive Order. Therefore, it is important to note that this Executive Order applies only to any mandate requiring the COVID-19 vaccine in the educational agencies and institutions noted above. This Executive Order does not eliminate or modify non-COVID-19 vaccine requirements in those agencies and institutions. Therefore, students attending schools located in New York State will continue to be subject to the vaccine requirements of New York Education Law Section 914 and Public Health Law Section 2164 and their corresponding regulations.
