Hey brokers what do you think – Who's responsible for the MLS fee? Back in the olden times, when you could say such things in a listing, seller-paid buyer’s broker’s compensation we'd see a percentage of purchase price adjusted down by $495 to “cover” the MLS fee. (A reduction of the buyer’s broker’s commission). In the new paradigm where buyers pay their brokers and not sellers; where we no longer advertise the commission splits; listing agents can't pass that fee through to their counterparts any more. So when a seller says they will only contribute X% - $495, that fee is passing through to consumers. And as a result, many buyers who thought that the seller was “covering” their brokerage charges in full are paying $495 out of pocket at closing. Are listing brokers still able to make a case that the fee should pass through to the buyer's side? Isn't this a cost of doing the business of marketing a home for sale? Or, are we now affording buyers the privilege of paying for a seller’s MLS marketing? Should buyer's brokers be doing more to push back against these terms for seller contributions towards buyer broker fees? Or to explain the consequences of having to pay $$ out of pocket? What do you think?
