The National Association of Patent Practitioners (NAPP) would like to nominate Genna Hibbs for the Council for Inclusive Innovation. Genna has been an active member of NAPP for many years, including holding several committee chair positions and presenting at our annual conference. She is a valuable team member who seeks engagement and is passionate about helping people. Genna is a patent attorney, and the founder and Principal Attorney of Hibbs law, LLC, a small intellectual property law boutique firm, located in Woodstock, Illinois. Located just outside the greater Chicagoland area, Genna provides legal services to marginalized inventors in both urban and rural settings. She provides wisdom and guidance to start-ups, small and privately held businesses, and individuals. She is passionate about diversity and inclusion and regularly participates in the USPTO Patent Hub program through the Chicago-Kent School of Law, where she provides pro-bono patent prosecution services for low-income inventors; as well as, volunteering with health innovation accelerators (MATTER) and LGBTQIA+ non profit organizations (Woodstock Pride).

On October 1, 2024, The United States Patent and Trademark Office (USPTO or Office) added a new rule to govern the process for the review of Patent Trial and Appeal Board (PTAB or Board) decisions in Leahy-Smith America Invents Act (AIA) proceedings by the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office (Director). The new rule promotes the accuracy, consistency, and integrity of PTAB decision-making in AIA proceedings. The National Association of Patent Practitioners (NAPP) is eager to announce that the proposed rule changes regarding Director Review outlined in the Federal Register at 89 FR 26807 were expanded to incorporate ex parte reexaminations and ex parte appeals as mandated by the US Supreme Court in Arthrex, Boloro, and Bottomline in Comment 6. NAPP has such skilled and helpful members!
Fellow patent practitioners, I had the most wonderful experience today thanks to the great advice of IP experts offered freely on the forums of the National Association of Patent Practitioners (NAPP.org) -- and the help of a patent examiner that I thought was super tough, but proved to actually be extremely kind and helpful. A case very important to me has faced a very rough road, including a "successful" appeal that lifted a rejection (in the pre-appeal conference) but sent the case back for further examination, resulting in a new rejection that recently was made final. Thanks to the guidance I received from some outstanding experts at NAPP, I made several changes or additions to my approach and immediately scheduled an interview that I didn't want to do based on what I felt were poor outcomes in prior interviews with this examiner. I also began digging more deeply into case law and the MPEP to prepare a long Request for Reconsideration under Rule 116, drawing upon the experience and wise strategies of David Boundy, a prolific sharer of wisdom in the NAPP forums. That process helped me focus more clearly on how best to frame the legal issues that helped me create a really clear one-page sheet of talking points for the interview beginning with a key question offered by Gary O'Neill. With all the help and preparation that came as a result of wise advice, the different approach I took today gave really surprising results. The Examiner suddenly was the most kind and helpful examiner I've met, like an old friend giving me a hand and even suggesting an additional argument to ensure allowance of all the claims, and important tips on expediting the allowance. Timing played a role, perhaps -- that was the point of some of the recommendations on the need to have an interview ASAP to align with some of the internal incentives in the USPTO, but there was more than timing alone, I think. My results today seemed like magic, but the magic would not have occurred had I not sought and listed to the advice of others through the NAPP. Where it not for them, I might be waiting for three years to gain "victory" in the slow appeal process. The low price of membership is trivial compared to the benefits that come from using the NAPP Forums and from learning from others in NAPP's meetings. It's an awesome organization.
