Did you hear? Late last week, a United States District Court for the Eastern District of Texas ruling has blocked the Corporate Transparency Act (“CTA”) nationwide. The CTA was enacted in an attempt for Congress to make it easier for the federal government to crack down on shell companies used for money laundering, trafficking, terrorism or other illegal activity. Although optometry practices are not involved in such activities, many would have been required to report information about their ownership to the U.S. Department of the Treasury by the end of 2024 or face substantial penalties of up to $500/day. In this week’s opinion, the Eastern District of Texas found the CTA to be “likely unconstitutional” and found that its looming January 1, 2025, deadline would irreparably harm companies that were required to comply. The injunction is preliminary, not permanent, for the federal law but does not affect state laws. The NOA and AOA will continue to provide updates on the CTA, including any potential appeals by the Treasury.

The Centers for Medicare & Medicaid Services (CMS) released the 2025 Medicare Physician Fee Schedule Final Rule. Of significant importance are the reimbursement changes to the fee schedule. Average payment rates under the fee schedule will be reduced by 2.93% in calendar year (CY) 2025, compared to the average amount these services were paid for most of CY 2024.
