⚠️New ILLINOIS Tax on LEASES⚠️ In case you missed it, Illinois just passed sweeping changes to the Retailers’ Occupation Tax on leases of tangible personal property, effective January 1, 2025. Here’s what those changes look like: ➡️ Lessors can purchase property exempt from tax. ➡️ Lessors must charge sales tax on lease streams. ➡️ Leases are now included in the definition of a sale. Until now, Illinois was one of the few states that did not tax most leases of tangible personal property. With this change, the state’s policies are becoming more like other states. New Businesses If you are starting a new business, it is essential to register for sales tax from the outset to ensure compliance with tax laws and avoid potential penalties. 2. Expanding Operations When you expand into new states or jurisdictions, registering for sales tax is necessary to meet your tax obligations in those areas. 3. Changing Circumstances Changes like ownership, structure, or operations often require a reevaluation of your sales tax registration. Don’t let these transitions leave you out of compliance. 4. Fluctuation in Sales Monitor sales in states where you don’t yet have nexus. If your sales increase, you may establish nexus and need to register. Conversely, during periods of downsizing, you might qualify to deregister or close accounts.
