Recently, in my US DOT-SAP FB Group, we had an interesting discussion, here's an excerpt: "For an owner/operator, his C/TPA serves as his employer for everything related to testing under 49 CFR part 382. He is required to enroll in a C/TPA. "The C/TPA puts him in a random pool of hundreds of other owner/operators. The C/TPA will notify him when he has been selected for a random test, and once notified, he must proceed immediately to a collection site which the C/TPA has designated. In the role of employer, the C/TPA receives the driver's test result, and then notifies him of that result. "The owner/operator is required to register on the Clearinghouse, and then designate his C/TPA as having authority to enter testing information on his dashboard, on his behalf. The C/TPA is responsible for recording employer-determined refusals, and other FMCSA violations that don't require a drug or alcohol test. When an owner/operator is audited, the investigator will go directly to the C/TPA, who will have a complete file of testing records and violations, including SAP reports. When a driver returns to driving after a violation, the C/TPA will order the return-to-duty test, and then will notify him of follow-up tests, in accordance with the SAP's follow-up testing plan. The C/TPA stands in the shoes of his employer. "NOTE: Do NOT let a driver tell you that "his wife" is his DER. For drug testing, his C/TPA is his DER. He is subject to all testing, with the exception of reasonable suspicion testing. (He could not order himself to take a reasonable suspicion test.) "When your client is an owner/operator, you must ask him who his C/TPA is. That is where you will send your SAP reports. He can't say he doesn't know...he writes an annual check to his C/TPA." Good to know!
