📢 Did You Know? Some Participants Can Skip RMDs... But Only Under Specific Conditions! Our #ERISA team recently answered a question that might surprise you: Can a plan participant legally skip required minimum distributions (RMDs) if they have a “242(b)(2)” election? The answer? Yes, but only under rare and specific conditions! 🔎 Understanding TEFRA 242(b)(2) Elections: Before the modern RMD rules went into effect in 1984, certain participants could make a TEFRA 242(b)(2) election under the Tax Equity and Fiscal Responsibility Act of 1982. If made before December 31, 1983, this election allowed them to follow the RMD rules that existed before 1984—which, in many cases, means they are not required to take RMDs today. 💡 Real Case Example: A 75-year-old retired participant had a large 401(k) balance but hadn’t been taking RMDs. The reason? They had a valid TEFRA 242(b)(2) election on file with their employer’s plan. Since they had never rolled over or transferred their account, their election remained intact ⁓AND⁓ they were not required to take RMDs under today’s laws. 🚨 Key Takeaways for Advisors: ✅ Only participants who made this election before December 31, 1983, are eligible. ✅ If a participant rolled over their account (to an IRA or another plan), the election became invalid, meaning they must take RMDs. ✅ Many plan sponsors and advisors aren’t aware of this rare provision, but it can be crucial for certain long-term participants. 📌 If you work with long-standing #retirementplan participants, it’s worth double-checking whether any may have a TEFRA 242(b)(2) election on file. ⁉️Have questions?
