W.C. Fields once said “If you can’t dazzle them with brilliance, baffle them with bullshit.” That’s precisely what the state of Maryland has apparently done in Willey v. Brown, our challenge to Maryland’s Red Flag Law. The case was before the Maryland Supreme court on two certified questions of law from the Maryland District Court, focusing on the evidentiary standard that Maryland’s Red Flag law requires in order for the issuance of certain types of Red Flag Orders. The statute says “reasonable grounds” without any definition, so the question for the Maryland Supreme Court was, well - what does that mean, and critically, is it less than probable cause? Here’s where the bullshit comes in: Between its arguments before the federal court, and the state Supreme Court, Maryland’s attorneys completely changed key parts of their arguments. Their positions changed so dramatically, in fact, that the Maryland Supreme Court has now decided that it can’t even decide the certified questions as they currently stand. So, now, the case will head back to the Maryland District Court where the State can try to explain its antics, and SAF can push to keep this case full steam ahead. In a case SAF is closely following, the Third Circuit has released its En Banc Opinion holding that an individual convicted of a non-violent misdemeanor (making false statements) cannot be subjet to lifetime disarmament under 922(g)(1). The Court held that the Plaintiff, Bryan Range, was indeed still a part of “the people” as contemplated by the constitution, despite is 1995 conviction - and that the Government had failed to carry it’s burden in proving that the nation’s historical tradition of firearm regulation at the time of the ratification supported such a lifetime ban. SAF has been working tireless on the issue of the Gun Control Act demanding lifetime firearm rights bans for individuals convicted of even the most non-violent offenses, including our Binderup case, which was a critical precursor to today’s decision.

SAF has filed a Reply in Support of our Supplemental Brief in FPC v. Garland, our challenge to the federal ban on the ability to carry a loaded firearm for self-defense on postal property and in the post office. The lawsuit seeks a permanent injunction against the carry and possession ban on USPS property.

Today, the Commonwealth of Pennsylvania asked the Middle District of Pennsylvania to stay (read, DELAY) our Motion for Summary Judgment in Brown v. Paris, SAF's case challenging the inability of young adults in Pennsylvania to receive a License to Carry Firearms. What should frustrate all of you as much as it does us is that NO discovery is necessary in this case - AND - today is the commonwealth's deadline to file its Response to our MSJ - a deadline they've already had extended. This is a transparent attempt by the Commonwealth to delay the proper progress of the case. A point we've made clear in our response to the Commonwealth's request.

Oral arguments were held before the Maryland Supreme Court today in Willey v. Brown, SAF’s challenge to Maryland’s Red Flag Law. While the primary case is located in federal court, a certified question of state law interpretation is central to the case, and must first be decided by Maryland’s high court.
