Kessler Matura P.C. has filed a class action lawsuit against Sienna Marketing & Consulting, Inc. d/b/a Creative Capital Solutions, alleging that the company misclassified its Associate Business Finance Loan Brokers (“Cold Callers”) as independent contractors and failed to pay them minimum wage and overtime. The Complaint alleges that Cold Callers work over 40 hours a week contacting as many businesses as possible to sell Creative Capital Solutions services. Although Creative Capital Solutions tightly controlled the work of our client and other Cold Callers, Creative Capital Solutions paid them as independent contractors. Through the lawsuit, on behalf of Cold Callers, we are seeking unpaid minimum wages, overtime wages, liquidated damages and other damages as a result of Creative Capital Solution’s violation of the New York Labor Law and Fair Labor Standard Act. SmartTalent, LLC, a temporary staffing agency, will pay $875,000 and provide other relief to settle a EEOC sex discrimination lawsuit. The EEOC charged that SmartTalent discriminated against women in hiring and job assignments since at least 2015. When the staffing agency received requests for male workers from some clients, the EEOC found that SmartTalent complied with those discriminatory requests instead of rejecting them as unlawful. The company denied female workers job placement opportunities and dissuaded some of its own recruiters who voiced concerns about such discrimination. Tactics some employers use to hide overtime While most workers in New York are entitled to time and a half for any time worked above 40 hours in a week, employers can be creative about “hiding” overtime and underpaying. New York State has paid over $2 billion in bonuses to more than 800,000 health care workers through the Health Care Worker Bonus Program. The program was launched by Governor Hochul in 2022 and provided bonuses of up to $3,000 for eligible #healthcareworkers across New York. The program issued payments to workers who provide hands-on and patient-facing health care services. Workers receiving payments through this program must have an annualized base salary (excluding any bonuses or overtime pay) of $125,000 or less and can be full-time or part-time. Bonuses payments were determined by specific "vesting periods," or the number of hours worked during a consecutive six-month period between October 1, 2021, through March 31, 2024. Qualified #employees received up to a maximum of $3,000 in total bonus payments over two vesting periods. Will you be paid if you miss work due to a weather event? The FLSA requires employers to pay exempt #employees their regular salary for any shutdown that lasts less than a week. Under the FLSA, employers generally are not required to pay non-exempt employees for any days that the employee does not perform any actual work.
