What is an Oral Will, and Why Is It No Longer Valid in Georgia? In Georgia, oral wills—or nuncupative wills—are a thing of the past. These verbal wills used to be recognized, but they're now invalid. Why? They were just too hard to prove! In Georgia, for a will to be legally binding, it must be written, signed, and witnessed. So, what happens if you make a "deathbed gift" with your words?
