ICYMI: the thumbs up emoji still constitutes contract acceptance👍👍👍 #eDiscovery #LegalTech
Remember this #ediscovery #caselaw ruling? In #canada, an appellate court dismissed an appeal, which meant that the thumbs-up #emoji still constitutes contract acceptance. More on the ruling here! #mobiledevices #textmessages https://lnkd.in/gEP3ty2d

What happens to deleted content on social media? Social media platforms allow for static content to be posted or removed at any time by the account user. Some content is even designed to disappear automatically after a period of time, like posts on Snapchat. For the most part, once content is deleted, it's gone and cannot be recovered. While there are not options for data recovery, there are ways to avoid the risks of content deletion with proactive, ethical, and savvy discovery processes. ⏰Timely Discovery: Early discovery research is paramount. Integrating social media and open-source data early in the discovery process is especially helpful for collection before a subject of interest has time to delete relevant information. 🔎Ethical Searching: It's also important to ensure the search is conducted by a third party to avoid an unethical or inadvertent interactions with the subject of your search. This also helps to avoid tipping off the subject that a search of their public information is happening. 🤝Relatives and Friends: Because social media is meant to connect us with each other, it's possible that friends or relatives of the subject of interest have shared relevant information publicly. A search of these key associates may result in finding relevant information about the subject of your search and the case. 🔦Monitoring: Continuing to check accounts and public online forums for updates at regular intervals can help catch information in real time. This can be particularly useful in capturing content that automatically disappears after 24 hours on platforms like Snapchat. So while recovering deleted information from social media channels is not possible, there are some things you can do to get ahead of content deletion with support from SMI Aware. Have any other questions about deleted content from social media? Let us know in the comments! #eDiscovery #SocialMedia #DeletedContent

Re-running a social media report could reveal more relevant data. 🔁 Did you order a report recently from SMI Aware? If so, you may want to consider ordering a report re-run. A re-run is when SMI Aware generates a second report on your subject, only this time, our expert analysts include anything that may have changed since the initial report. This could include: 1. Additional images, videos, posts, and comments on a subject's profile. 2. New social media profiles on emerging platforms. 3. Public content that was previously unavailable or marked private. 4. Private profiles that were previously publicly available. Lots of social media content is published over the holidays. Don't miss out on finding and preserving critical information online for your case. SMI Aware re-runs reports that were placed less than 6 months ago for half price! To rerun a recent report, simply log onto the application, select the report and click "rerun." #legaltech #socialmedia

Put a PIN in this post! 📍 Pinterest launched for the first time 15 years ago today! 🎉 Pinterest allows users to publicly share categorized boards with ideas. It's also one of the platforms we extensively search and highlight in our Deep Reports at SMI Aware. Posts to Pinterest may lend themselves to discovery strategies for legal cases, pre-employment screenings, and risk assessments. Things we have found on Pinterest boards that have helped legal discovery efforts: →Themed boards with images of alcohol or illicit substances →Images of food or recipes that might indicate an inappropriate diet for an existing condition, or medical problem →Extreme political or religious views →New Job Clothes boards with outfit ideas for someone who might be looking to make a job change. The bottom line: information on Pinterest and other social media platforms can play a vital role in your legal strategy. It's risky to collect information like this on your own, so having a partner like SMI Aware to assist with data collection and preservation is important. Want to start integrating social media discovery into your legal strategy? Contact SMI Aware to learn more. #Pinterest #pinpinpin #SocialMedia #OSINT

Experienced humans are a vital part of technology. 👩💻👨💻 A recent article by Judge Scott Schlegel highlighted the importance of not just human-supervised AI in legal, but that an experienced and knowledgable human is critical to successful implementation of technology like AI. At SMI Aware, we couldn't agree more! And although we currently do not utilize AI in our report process, we place high value in our team of human analysts. Our analysts are experts at social media and open-source discovery. They are well-versed at using our suite of technology and tools to complete this research comprehensively and ethically. They comb through results by hand to find the most relevant and important information based on the scope of the research project. Judge Schlegel is right - "human in the loop" isn't good enough. Expert human executed technology is necessary. Check out the full article here: https://lnkd.in/guTBnzi3 #humanintheloop #LegalTech #eDiscovery
