I'm very pleased and excited to be presenting to international graduate students as part of Penn State's Global Career Institute. Held at Penn State's Great Valley campus, the two-day program features sessions aimed at helping international students bring their skills and knowledge to the U.S. labor market. My program, entitled "Transitioning from Campus to the Workplace: Emerging Issues for International Students", offers guidance on how international students can navigate the challenges of the U.S. immigration system for the benefit of U.S. employers. We recently had an important win in the Eastern District of Pennsylvania. The Government tried to dismiss our complaint for Writ of Mandamus for a couple who had waited over 23 months for their I-601A provisional waiver adjudication (uscis processing times for this type of case are currently 43.5 months). The Government argued that “no action” on a case was in fact “action” and that this couple basically had no choice but to “wait in line”. Judge Beetlestone denied the government’s motion to dismiss and went even further- proposing that a two year waiting period is an unreasonable delay.
