Said every lawyer to every witness: "𝐈 𝐝𝐨𝐧'𝐭 𝐰𝐚𝐧𝐭 𝐲𝐨𝐮 𝐭𝐨 𝐞𝐯𝐞𝐫 𝐠𝐮𝐞𝐬𝐬 𝐨𝐫 𝐬𝐩𝐞𝐜𝐮𝐥𝐚𝐭𝐞 𝐛𝐮𝐭 𝐈 𝐝𝐨 𝐰𝐚𝐧𝐭 𝐲𝐨𝐮 𝐭𝐨 𝐠𝐢𝐯𝐞 𝐦𝐞 𝐲𝐨𝐮𝐫 𝐛𝐞𝐬𝐭 𝐞𝐬𝐭𝐢𝐦𝐚𝐭𝐞" This standard admonition is given to every witness before they testify to ensure they give reliable and trustworthy testimony. The law thus recognizes that: ➡️ Estimations are considered to be reliable and trustworthy. ❌ Guesses and speculations are not considered reliable and trustworthy. Same goes for billing your time. ➡️ Estimations are reliable and trustworthy. ❌ Guesses and speculations are not. But here is my caveat: Estimating what you did and the amount of time it took to complete it is reliable evidence IF you are entering your estimation as close in time to the task completed as possible. 𝐓𝐡𝐞 𝐥𝐨𝐧𝐠𝐞𝐫 𝐲𝐨𝐮 𝐰𝐚𝐢𝐭 𝐭𝐨 𝐞𝐧𝐭𝐞𝐫 𝐲𝐨𝐮𝐫 𝐛𝐢𝐥𝐥𝐢𝐧𝐠, 𝐭𝐡𝐞 𝐦𝐨𝐫𝐞 𝐥𝐢𝐤𝐞𝐥𝐲 𝐭𝐡𝐚𝐭 𝐞𝐧𝐭𝐫𝐲 𝐰𝐢𝐥𝐥 𝐛𝐞 𝐚 𝐠𝐮𝐞𝐬𝐬 𝐨𝐫 𝐣𝐮𝐬𝐭 𝐬𝐩𝐞𝐜𝐮𝐥𝐚𝐭𝐢𝐨𝐧, 𝐫𝐚𝐭𝐡𝐞𝐫 𝐭𝐡𝐚𝐧 𝐚𝐧 𝐞𝐬𝐭𝐢𝐦𝐚𝐭𝐢𝐨𝐧. But after creating an "𝗘𝘃𝗲𝗿𝘆𝘁𝗵𝗶𝗻𝗴 𝗶𝘀 𝗕𝗶𝗹𝗹𝗮𝗯𝗹𝘆 𝗙𝗶𝗴𝘂𝗿𝗼𝘂𝘁𝗮𝗯𝗹𝗲" mentality, I stopped all the confusion cutting and started composing value-packed billing narratives that captured ALL of my time. Here's how you can too. To cut through the billing confusion, ask yourself this question: 1. 𝗗𝗶𝗱 𝘁𝗵𝗲 𝘁𝗶𝗺𝗲 𝗜 𝗷𝘂𝘀𝘁 𝘀𝗽𝗲𝗻𝘁 𝗺𝗼𝘃𝗲 𝗺𝘆 𝗰𝗮𝘀𝗲 𝗳𝗼𝗿𝘄𝗮𝗿𝗱 𝗶𝗻 𝗮𝗻𝘆 𝘀𝗺𝗮𝗹𝗹 𝘄𝗮𝘆? Did it help to: ➡️ Mitigate potential financial risks for my client? ➡️ Maximize a more favorable outcome for my client? ➡️ Evaluate the possible impact on overall case strategy? ➡️ Further facilitate early case resolution? ➡️ Strategically determine alternative case action? ➡️ Seek possible exclusion of damaging evidence at trial? ➡️ Reduce the escalation of the case towards trial? ➡️ Better establish a solid legal foundation for my client's case? ➡️ Expose possible weaknesses in opposing side's case? If so, then it's billable time. 𝗣𝗿𝗼 𝗕𝗶𝗹𝗹𝗶𝗻𝗴 𝗧𝗶𝗽: 𝗬𝗼𝘂𝗿 𝗮𝗻𝘀𝘄𝗲𝗿𝘀 𝘁𝗼 𝘁𝗵𝗶𝘀 𝗾𝘂𝗲𝘀𝘁𝗶𝗼𝗻 𝘄𝗶𝗹𝗹 𝗵𝗲𝗹𝗽 𝘆𝗼𝘂 𝗰𝗿𝗮𝗳𝘁 𝘆𝗼𝘂𝗿 𝗯𝗶𝗹𝗹𝗶𝗻𝗴 𝗻𝗮𝗿𝗿𝗮𝘁𝗶𝘃𝗲! There is only 1 reason why you haven't committed to billing your time contemporaneously... And that reason? 𝐘𝐨𝐮 𝐤𝐞𝐞𝐩 𝐰𝐞𝐢𝐠𝐡𝐢𝐧𝐠 𝐚𝐧𝐨𝐭𝐡𝐞𝐫 𝐨𝐩𝐭𝐢𝐨𝐧. That option? It's simply different versions of entering your time "later" option. Different versions of reconstructing your time later. Over and over and over again you decide NOT to commit to the contemporaneous timekeeping option because your brain keeps weighing the seemingly more appealing option of reconstructing your time later. And so you will likely bill your time... 👉 At the end of the day "because I don't have time to bill right now" 👉 Tomorrow morning "before I start work" 👉 At the end of the week "before I leave the office" 👉 Sunday night "when I don't have anyone bothering me" 👉 At the end of the month "because that's the only time I finally feel motivated to do it" So what's so appealing about this option? ➡️ It feels easier in the moment when things are busy. ➡️ It gives you relief in the moment from the pressure to get to the next email - and the next. ➡️ It allows you to continue to get to everyone else's needs in the moment. ➡️ It releases some of the momentary dread you feel around having to bill your time - especially "when it never feels like enough" ➡️ It extinguishes the momentary confusion you feel over how to bill for what you just did or if it even is billable. But remember - all of this appeal is momentary. All of this appeal loses it's appeal when it's the end of the month and you still have a ton of billing to catch up on. All of that dread All of that confusion All of that pressure comes right back So how do you commit to only the contemporaneous timekeeping model? 𝐘𝐨𝐮 𝐜𝐨𝐦𝐦𝐢𝐭 𝐭𝐨 𝐩𝐫𝐢𝐯𝐚𝐭𝐞 𝐜𝐨𝐚𝐜𝐡𝐢𝐧𝐠 𝐰𝐢𝐭𝐡 𝐦𝐞.
