As URAC’s President and CEO Shawn Griffin, MD points out, many discussions focus on the “wow” of AI but not enough on the “how.” How do we ensure informed consent for AI-assisted decision-making in clinical care? How do we maintain HIPAA compliance and protect patient privacy in an era of real-time data exchange? How do we safeguard against conflicts of interest when health systems develop and deploy AI tools? Innovation in health care must always be grounded in trust, transparency and patient-centered care. Regulation may take years to catch up, but our industry must hold itself accountable now. At URAC, we recognize the need for independent oversight, ethical frameworks and safeguards that ensure AI enhances, not erodes, patient trust.
I think 75% of my daily medical and policy news articles this year have had some mention of AI. I admit that some of the technology I have seen in the field is impressive, but I still see a primary focus in stories on the "wow" and not the "how." While I appreciate the opportunities that AI has/can bring to healthcare, as a former Chief Medical Information Officer at a few systems I do have a few questions: Where is the patient informed consent discussion for utilization in clinical care decision-making and even just presence in the exam room? I strongly embrace the opportunity to help with documentation and decrease burn-out, but do we ask patients for permission before we use it? I know when I worked with medical students in my clinic, I would always ask my patient if they were comfortable with having another person in the room. Should this be different? Are the data tools following HIPAA rules or do I need to worry that my conversation with my doctor will lead to my smart watch prompting me to buy dandruff shampoo? When these programs are in use, where is the conflict-of-interest transparency? If a health system is piloting a tool with hopes to commercialize it, is there an IRB review or any required disclosure to the patient or the public? How are pilots of AI tools handled outside of the usual large health system infrastructure? We have seen that not all innovation comes from large institutions. What are the rules that the "disruptive innovators" should follow and who is watching independently to make sure that rush to returns doesn't cause more traditional steps to get skipped? I'm pretty sure I remember medicine is not a "move fast, break things" world, but more of a "first, do no harm." In an area where the tech can cause daily billion dollar swings in value, and regulation can take months/years to pass (and when it does lawsuits can further delay oversight), what are the voluntary rules we are willing to enforce on each other and how do we foster innovation while still ensuring trust by the people we took an oath to serve?
