🔔[#AI regulation] Introduction of the #NoFakesAct: A Bipartisan Initiative to Protect #DigitalReplicas ✨ In a significant move, a group of US senators has introduced a few days ago the No Fakes Act, a new piece of legislation aimed at protecting the rights of individuals regarding their digital replicas and hence create a federal right to publicity which only exists in certain states. Key Provisions of the No Fakes Act: 1. **Universal Right to Control:** Establishes that individuals have the exclusive right to control their digital likenesses and representations. 2. **Consent Requirement:** Mandates that any use of an individual’s digital replica must be authorized through explicit consent, hence outlaws the creation and distribution of #deepfake content without consent with exceptions for news, broadcast, advertising/ marketing and documentary use, public criticism or commentary and “fleeting or negligible” use. 3. ** Licensing Mechanism.** No assignment but possibility to license in writing with a reasonably specific description of intended uses limited to max 10 years. 5. **Industry Accountability:** Adopts a safe harbor provision for AI software developers and a notice-and-takedown mechanism for online platforms; similar to the current online (c) regime, the takedown system would immunize platforms from liability if they promptly remove unauthorized replicas. 6. **Penalties for Violations:** Introduces penalties for those who violate the provisions of the act, ensuring that there are consequences for unauthorized use.
