  • ⚡ EDPB ADPOTED NEW GUIDELINES ON PSEUDONYMISATION On January 17, 2025, the European Data Protection Board (EDPB) adopted new guidelines on pseudonymisation for public consultation and issued a statement regarding the interplay between data protection and competition laws. 📌 Pseudonymisation Guidelines: The guidelines clarify that pseudonymised data—information that can be attributed to an individual using additional data—remains classified as personal data under the General Data Protection Regulation (GDPR). This means that even if data is pseudonymised, it is still subject to GDPR requirements. Additionally, the EDPB highlights that pseudonymisation can mitigate risks and facilitate the use of legitimate interests as a legal basis for processing, provided all other GDPR conditions are satisfied. It also supports compatibility with the original processing purpose. 📌 Interplay Between Data Protection and Competition Laws: In its position paper, the EDPB emphasizes the necessity for cooperation between data protection and competition authorities. Recognizing that these legal areas may overlap, the EDPB suggests steps for integrating market and competition factors into data protection practices and vice versa. Recommendations include establishing a single point of contact to enhance coordination between regulators, ensuring effective and coherent enforcement of both data protection and competition laws.   • ⚡ GOOGLE AND MICROSOFT SUED FOR USING PERSONAL DATA FOR AI TRAINING Barings Law, a UK-based law firm, has filed a lawsuit against Google and Microsoft on behalf of 15,000 individuals, accusing them of unlawfully collecting and using personal data to train AI systems. The case highlights alleged misuse of sensitive information, such as emails, demographics, and app usage, without user consent. Services like Gmail, LinkedIn, and Xbox are among those implicated.   • ⚡ CJEU RULED AGAINST LIMITING DATA SUBJECT COMPLAINTS! The Court of Justice of the European Union (CJEU) has just ruled against Austria's Data Protection Authority (DSB) for limiting complaints to two per month, a policy deemed contrary to GDPR rights. The CJEU judgment in Case C-416/23 addresses the obligations of supervisory authorities under GDPR. It clarifies that data protection authorities (DPAs) must handle complaints effectively, ensuring transparency and proportionality. Authorities may charge fees or refuse requests only if they are manifestly unfounded or excessive. The court highlighted the need for sufficient resources to enforce GDPR and emphasized that complaints must not be unjustly dismissed. This ruling underscores the balance between facilitating data subjects' rights and maintaining operational efficiency. The DSB has faced criticism for dismissing cases and failing to impose meaningful penalties, with only 1.36% of cases resulting in fines. Structural inefficiencies, prolonged case timelines, and resource constraints exacerbate these issues. This reflects broader EU-wide problems with data protection enforcement.
