As healthcare spending continues to rise, pharmacies increasingly face scrutiny by the U.S. government for potential violations of the False Claims Act (FCA). The FCA is frequently leveraged to address concerns about false billing or misrepresentations of services. Pharmacies can face FCA investigations for various reasons, but effective negotiation strategies can help minimize liability and reputational harm. For more information on properly challenging these claims, read Angelo Cifaldi and Joseph Carlo’s full blog post: https://lnkd.in/daAPR92k

The 5th Circuit Court recently struck down the Department of Labor’s 2021 rule that limited the amount of time tipped employees could spend on non-tip generating tasks like cleaning or food prep. This ruling is a major win for hospitality employers, who no longer need to follow the strict “80/20” rule. Make sure you're staying compliant with both federal and state wage & hour regulations. Effective January 1, 2025, New York’s Paid Prenatal Leave Law ensures all pregnant workers are eligible for up to 20 hours of paid leave per year for prenatal care, separate from other leave types. This leave covers medical appointments, fertility treatments, and other pregnancy-related healthcare, while protecting employees from retaliation. Employers should ensure clear communication and compliance with this new law. For more details, read Tracy A. Armstrong’s full blog: https://lnkd.in/ejruEbe9

In a key decision, the Pennsylvania Superior Court reversed a trial court ruling, clarifying what constitutes a "first mortgage" in foreclosure cases. The court ruled that the "first mortgage" is the first lien recorded on the property at the time of the foreclosure, regardless of whether it was the original mortgage or a refinanced version. This decision came in the case of Foxfield at Naaman’s Creek Homeowner Association v. Eventoff, which, after the initial trial court ruling, was handled by Wilentz attorneys Dan Bernheim and Jonathan Bart.
