The promise of fair pay for a hard day's work has long excluded individuals with disabilities. This proposal is a key step toward correcting that. Section 14(c) of the Fair Labor Standards Act (FLSA) allows the Secretary of Labor to issue certificates permitting employers to pay subminimum wages to workers with disabilities, but only if necessary to prevent job opportunity reductions. On December 3, the Department of Labor proposed a rule to end the issuance of new 14(c) certificates and phase out existing ones over three years. The department argues that subminimum wages are no longer needed to provide job opportunities for workers with disabilities. If finalized, the rule would not require workers to leave their current jobs or for employers to change their services, but it aims to help many workers transition to full-wage employment, benefiting both workers and society.
