Macquarie US asset manager pays $80m to settle fraud charges with SEC for inflated valuations and cover-up trades. Macquarie Investment Management Business Trust (a US registered investment adviser) systematically overvalued collateralized mortgage obligations (remember the securities at the origin of the 2008 financial crisis?) held in 20 advisory accounts including 11 retails mutual funds. When investors wanted to redeem, Macquarie engaged in cross trading between advisory clients, buying and selling at the inflated, out-of-market prices to avoid the losses. This is a breach of fiduciary duty that leads at least to 1) overstated performance (a deceptive practice that can be considered fraud) and 2) unequal treatment of clients i.e. favouring some over others. What else? My take is that at the root were Macquarie’s internal valuation rules, which lacked precision to value illiquid, odd lots CMOs. Macquarie will now pay $80 m and review its policies and procedures on valuation, liquidity risk and cross-trading. I recall a similar case involving Allianz Global Investors U.S. LLC in May 2022 of a pretty damning misrepresentation fraud in its Structured Alpha funds. The company had to pay $6 bn in fines and restitution and abandon the US market for 10 years. https://lnkd.in/d57fUk8V Add to the fine the hit to your reputation. 🚨 SEC Charges Macquarie Investment Management with $80 Million Fraud 🚨 Macquarie Investment Management Business Trust (MIMBT) was accused by the SEC of carrying out illegal cross trades that unfairly hurt regular mutual funds and overvaluing illiquid collateralized mortgage obligations (CMOs). MIMBT executed hundreds of internal cross trades between accounts, inflating asset prices and masking losses. Key Allegations: ▪️ Asset Overvaluation: MIMBT misled investors by inflating client account -performance through faulty pricing. ▪️ Illegal Cross Trades: They shifted inflated CMOs between accounts to protect themselves from losses, benefiting certain customers while retail mutual funds bore the brunt of the losses. MIMBT is going to pay $79.8 million in penalties and change its compliance. This case emphasizes the value of precise asset appraisal and openness from the standpoint of a CFE.
