The Bridge team uses its deep knowledge of how to fully navigate the system to help others see that those with physical or intellectual disabilities needn’t think that nursing facilities and institutions are their only options. Instead, they can confidently move beyond their limitations, remain at home, and thrive.

#NursingHome residents on Medicaid who have been “placed” in #nursinghomes have the right to choose to live in the community i.e. least restrictive most integrative environment with the home care services and supports they need to live safely. The violation of their rights has resulted in multiple State lawsuits by these “class action lawsuit members” (nursing home residents). This group of individuals has successfully and legally pursued their choice to be transferred to community residences with the support and services needed in IL (i.e. one example in Illinois - the group of ongoing consent decrees #Ligus, #Colbert and #Williams ). These consent decree lawsuits have stated that without presenting these individuals with choice or provisions would violate the #AmericanDisabilityAct (#ADA) and #OlmsteadAct #OlmsteadDecision. In order for Colorado and other states to have the success that Illinois has demonstrated, States must identify and provide #AffordableHousing and adequate numbers of and well prepared #HomeCareWorkers . Barriers to success for smooth and timely transition of these Class Members to community residences (e.g. homes, apartments, small group homes, assisted living) require States to have adequate plans for all aspects of carrying out the necessary components of these consent decrees such as #AffordableHousing , #HomeCareWorkers, #HomeHealthCare Former nursing home residents transitioning into community living require assistance with 3 or more daily living tasks (#ADLS, #IADL) and/or other accomodations (e.g. dressing, bathing, laundry, meal prep, accessible housing when using a wheelchair), @HomeHealthCare Until #homecare / #healthcare workers are able to earn a salary, better aligned with the required skills that match the needs of their care recipients, there will be a shortage of this very valuable workforce. The State of IL has learned from the Olmstead Settlements that benefited the class members of the Ligus, Colbert and Williams class action lawsuits and their subsequent consent decree settlements. When it comes to long-term care, you have two main options: in-home care or residential care. In-home care allows you to receive the support you need while living independently in your own home. Nurses with Disabilities: Discriminating against our own. In an environment where empathy and compassion are supposed to be at the forefront, we are not protecting 'our own.' Why? What can organizations do to protect any providers with disabilities and utilize the unique strengths these providers can bring to the table? An organization's policy and procedures regarding this issue, according to the ADA, must provide reasonable accommodations unless doing so would result in undue hardship. No internal policy can bypass this obligation. While an organization can develop its policies and procedures to manage operations, these must be consistent with federal and state laws. What are your thoughts about this unique situation? Is your organization adhering to the ADA and Rehabilitation Act of 1973? These protections aim to create an inclusive work environment where nurses with disabilities can continue their careers without fear of unjust job loss.
