Recently, I was approached by a client facing a distressing situation. Despite a Family Court order detailing a custody arrangement where the father had the child from Monday to Wednesday and the mother from Thursday to Sunday, an unexpected complication arose. When the mother went to pick up her child on Wednesday night, both the father and child were missing from the premises. In the pursuit of a quick remedy, we approached High Court, which ultimately secured the desired relief for the mother. However, this case highlighted a critical oversight in the Family Court's order: it did not explicitly direct the "court order to be sent to the concerned police station", a step crucial for enforcement. When the client approached the police for assistance, they declined to act, citing the absence of a specific order to the 'concerned police station' as the reason. This gap in procedural clarity delayed the immediate resolution the client sought, underscoring the importance of ensuring that such directives are included in custody orders for smooth enforcement.
