The research shows that, sadly, the implicit and explicit dicrimination against Asian Americans in many Emerging Manager programs is alive and well. - Just under a fifth of US investors run emerging manager programs that include diversity criteria - Among investors with emerging manager programs, nearly a third fail to include AAPIs - Newer emerging manager programs are less likely to explicitly include AAPIs - AAPI-owned firms are overlooked even by investors that claim to include them - Emerging manager initiatives do not significantly improve AAPI-owned firms’ access to capital - AAPI-owned firms are more likely to receive re-ups compared with other firms

SEBI has recently amended the regime governing creation of encumbrances by Alternative Investment Funds (AIFs) to inter alia permit Category I and Category II AIFs to create encumbrances over the equity of an investee company in the infrastructure sector. Curiously, this permission formalizes a restriction on creation of encumbrances over shares of investee companies in other sectors, which was first expressed by SEBI in an order passed in 2023 but was previously perceived as not being restricted.
