This is my reminder to my network about what I do. Remember, it doesn't matter how good you are at something if no one knows you do it. I'm an employment lawyer who primarily represents workers. I will, however, recommend an employer on two conditions: 1) the company has a commitment to diversity and inclusion, and 2) the company is actively trying to do its best for its workers. There are many reasons why a company should hire a plaintiffs' lawyer, and in particular, my law firm. Here are four good ones: 1) My firm is good at what we do. In the past three years, we've survived almost ten dispositive motions and won two jury trials. We've only had one case end in a loss in three years. 2) I can't sue you if you hire me (conflicts). Thus, you will not have to worry about point number 1. 3) We don't want to bill you to death. We prefer representing employees and that's our bread and butter. You will get sound legal advice at a fraction of the cost because we aren't looking to bill you for long-term litigations. That's not our model. 4) Simply by hiring us, you will show a commitment to diversity and inclusion. My law firm is one of the only Black-owned law firms focusing on employment issues. And we bring a different perspective given our lived experiences to the matters we work on.

I've practiced long enough in South Florida to witness numerous big hitting lawyers run unethical practices and go down, lose their licenses, go to prison, and take young lawyers down with them. To you, young lawyers, a foundational question to ask yourself is are you going to work for an ethical and professional law firm with ethical and professional lawyers. I don't care how much they're paying you. What the bonus will be. What the fringe benefits are. A foundational question is - will they play be the rules. If you think they won't, you suspect they won't, you smell they won't, your instinct tells you they won't, never take that job offer. Even it's your only one. Don't take it. You can always figure out another option. What you can't do is practice without a license, and you may well lose it by working for a shady firm.

I recently interviewed Kelly Chanfrau, a leading trial lawyer in Northeast Florida who specializes in plaintiff employment cases while also handling injury cases with her families long–established firm in Daytona Beach. Kelly learned how to practice at the foot of her father whom she described as a master storyteller and the best trailer lawyer she's ever seen. Employment cases are hard to pursue. We discussed some of the factors including summary judgment. “A plaintiff can't just bring a case to the jury, she has to bring it first to the judge”. This underscores the importance of collecting witness statements and declarations early in a case in anticipation of summary judgment. Kelly emphasized the need to know the elements of the causes of action you deal with daily as well as the affirmative defenses. Kelly and I had the opportunity to work on a multi-plaintiff employment case. These present special challenges: separate sections of opening statement, separate liability presentations and separate damages calculations. Despite the risks trial is sometimes necessary. Kelly recalled a sign on a judge’s door: “It's OK to go to trial". "Sometimes your client deserves their day, they want it and it's your job to take it", she said. She firmly believes in developing a "trial scenario" (trial plan) early in the case and it needs to tell a story. It's critically important to portray the plaintiff as a survivor and not a victim. Both of us are fans of Jesse Wilson's wonderful book “Witness Preparation" which hammers this lesson home. Did You Know This? 👍Before I tell you more, if you are interested in employment litigation, LIKE this post so I can learn what topics you want to hear about. ⚖️Employers are much more likely to sue employees than they used to be. ⚖️One of the types of litigation clients my law firm helps are: ➡️Defendants in a lawsuit, usually an executive or higher-up employee that's been sued by their former employer, and; ➡️They have been accused of stealing confidential information, taking clients, or competing with their former employer in some way. ➡️The client's former employer will file a lawsuit with minimal facts, and will use the lawsuit as a bargaining chip or an intimidation factor to try to force the former employee to not go after their customers, or to try to avoid paying severance to the employee. ⚖️Many times, but not always, the employee has less financial resources than the employer, which means they need to hire litigation counsel that is precise, resourceful, and strategic - and won't churn their file. ➡️Usually, the employer is trying to get access to the former employee's personal cell phone, or has already accessed it, sometimes in a high-pressure, sneaky way. By having access to the employee's text messages and emails, the employer is able to fish around for incriminating evidence. ➡️My firm loves helping employees and executives in these kinds of cases, and also represents employers too.
