For retailers, sensitive consumer data, such as geolocation or browsing behavior, is now under sharper scrutiny, making compliance non-negotiable. In a joint statement released by the FTC Commissioners in January 2024, the FTC reaffirmed that "sensitive data triggers heightened privacy obligations and a default presumption against its sharing or sale" [1]. This was evident in several recent enforcement actions, including consent orders involving X-Mode, InMarket, and Avast. Notably, these orders underscored the heightened sensitivity of location and browsing data [2]. The Blackbaud case further illustrates the FTC’s commitment to enforcing strong data retention practices and ensuring transparency in breach notifications [3]. Immediate actions retailers should take: 1. Review Data Collection Practices: Ensure transparency and fully inform users about the nature and purpose of the data being collected. Tools like Privacy Impact Assessments (PIAs) can aid in identifying risks. 2. Enhance Consent Mechanisms: Implement explicit, unambiguous opt-in consent processes, particularly for sensitive data categories like geolocation and browsing records. 3. Implement Data Retention Policies: Regularly audit and delete unnecessary or outdated consumer data. Ensure the data retention schedule complies with FTC expectations and avoid holding onto unnecessary information. 4. Strengthen Breach Notification Procedures: Develop a robust incident response plan that ensures prompt, accurate, and detailed communication to affected users in the event of a breach. These steps will not only protect consumer trust but also reduce the risk of FTC enforcement.
