While the causes of these increases are debated, pharmacy benefit managers (PBMs) have recently come under scrutiny, facing both litigation and regulatory action. As intermediaries between drug manufacturers and insurance providers, PBMs are expected to leverage their scale for cost savings. However, as their influence grows, so does the call for transparency and regulation. States like Kentucky, Florida, and Vermont are enacting laws to regulate PBM pricing models, requiring fair reimbursement practices and prohibiting spread pricing. With ongoing discussions at both state and federal levels, it's crucial for benefits professionals to stay informed about these developments. UnitedHealth will soon be passing all rebates from the Prescription Drug Manufacturers to employers. A Pharmacy Benefit Manager with a "pass-through" model offers advantages like increased transparency in pricing, allowing employers and plan sponsors to see exactly how much they are paying for prescription drugs. The FTC report, which cites Frier Levitt three times, found that vertical integration gives PBMs the ability and incentive to prefer their own affiliated businesses, disadvantaging rivals and independent pharmacies, and increasing drug costs. The FTC report reveals alarming PBM concentration, where the top three PBMs now process 80% of all US prescriptions. Vertically integrated PBMs/insurers/pharmacies control 70% of specialty drug revenue. This consolidation raises serious concerns about drug pricing and access. Additionally, the report reveals PBMs’ delayed data compliance hampered the investigation, limiting the ability to fully examine potential steering of prescriptions to PBM-affiliated pharmacies.
