New Home Affairs Minister Dr Leon Schreiber extends temporary visa concession to safeguard applicants from adverse consequences caused by processing delays Applicants whose visa applications are still pending: Visa holders who have applied for long-term visas (Visitor’s Visas in terms of section 11(1)(b) and 11(6) of the Immigration Act, 2002; Business Visas, Study Visas, Relative’s Visas and Work Visas) and whose application is still pending as at 30 June 2024, are granted a further temporary extension until 31 December 2024 of their current visa status. Applicants are not allowed to engage in any activity other than what the visa conditions provide for. Those who wish to abandon their visa applications will be allowed to exit at a port of entry before or on 31 December 2024 without being declared undesirable in terms of section 30(1)(h) of the Immigration Act, 2002 read with regulation 27(3) of the Immigration Regulations, 2014. Visa holders who need to travel, but are awaiting the outcome of a long-term visa application, will be allowed to exit and re-enter at a port of entry up to and including 31 December 2024, without being declared undesirable in terms of section 30(1)(h) of the Immigration Act, 2002 read with regulation 27(3) of the Immigration Regulations, 2014. Yesterday, Minister Leon Schreiber published new regulations and waiver letters for general work and critical skills work visas. While we appreciate the introduction of the Points-Based System (PBS), it lacks the comprehensiveness found in other countries, where a wider range of criteria, such as age, family ties, and dependents, are considered. The current system restricts opportunities to those with high qualifications (NQF level 7-9) or earning between R650,796 and R976,194, leaving out for example, essential professionals like social workers and teachers and others. Moreover, the PBS and critical skills list exclude individuals with valuable years of experience but no formal qualifications, which contradicts the Immigration Act. We've already seen the negative impact on skilled professionals, like a client with over 20 years of experience in senior management who is now unable to renew his visa. Additionally, the new regulations create confusion around the general work visa process, particularly for ZEP holders who may not meet the PBS requirements despite the blanket waiver of the Department of Labour recommendation. We however acknowledge that these regulations represent positive steps toward a more robust immigration system. Minister Schreiber has achieved remarkable progress in a short period, especially considering the challenges he inherited within a complex and broken portfolio. We commend his dedication to reform and believe wholeheartedly in his commitment to improving South Africa’s immigration policies. We are confident that further clarifications will be provided, ensuring that these regulations achieve their intended impact while supporting key groups, including ZEP holders. Immigration Minister expresses intent to hold more domestic draws On March 21st, Immigration Minister Marc Miller made a significant announcement regarding Canada's immigration policy. Miller expressed his intention to pursue more “domestic draws” for temporary residents already in Canada who are candidates for permanent residence (PR). This initiative aims to address the country's critical support sector pressures, such as housing and healthcare, by facilitating the transition of temporary residents to permanent status. What are domestic draws? "Draws" in the context of Canadian immigration refer to selection rounds through pathways like Express Entry managed programs. In these draws, candidates from a pool are chosen based on their Comprehensive Ranking System (CRS) scores, professional experience, or language abilities, and are issued invitations to apply (ITAs) for PR. The concept of “domestic draws” specifically targets individuals already residing in Canada on temporary visas, such as work or study permits. Miller’s announcement was part of a broader strategy to manage temporary resident levels in Canada. He emphasized that more domestic draws would help integrate temporary residents into the Canadian workforce and society. This shift is designed to transition those already contributing to Canada’s economy and social fabric into permanent residents, thus reinforcing stability and continuity in various sectors. “We will have more domestic draws for us (the federal government) and ask provinces and territories taking part in the Provincial Nominee Program to do the same with their allocations,” Miller stated. This approach underscores a collaborative effort between federal and provincial governments to streamline the path to PR for temporary residents.

Considerations: - Residency and Compliance Verification: Annual confirmations and IRS checks. - Public Awareness: Campaign to inform potential applicants. - Economic Stimulus: Offering a clear path to permanent residency and citizenship incentivizes legal aliens to remain in the U.S., invest in their communities, and continue their economic contributions. This includes skilled workers on H1B visas who can enhance innovation, as well as farm laborers whose consistent presence supports agriculture, a critical sector of the economy. This policy aims not only to streamline the immigration process but also to celebrate and integrate those who have already shown their commitment to the American dream through their actions. By adopting such a policy, the U.S. can continue to be a beacon of hope and opportunity while ensuring that its immigration system reflects its values of hard work, responsibility, and community.
