𝐖𝐡𝐚𝐭 𝐚𝐫𝐞 𝐭𝐡𝐞 𝐫𝐮𝐥𝐞𝐬 𝐟𝐨𝐫 𝐝𝐢𝐯𝐨𝐫𝐜𝐞 𝐢𝐧 𝐑𝐰𝐚𝐧𝐝𝐚? Article 248 of the Law nº 71/2024 of 26/06/2024 governing persons and family Official Gazette n° Special of 30/07/2024 provides for grounds for divorce. Each of the spouses may lodge a claim for divorce on one of the following grounds: (a) adultery; (b) desertion of matrimonial home by one of the spouses without justifiable ground for at least 12 consecutive months; (c) a conviction for an offense severely damaging reputation; (d) refusal to provide for household expenses; (e) physical, psychological, emotional violence, economic harm or grossly abusive conduct against the claimant, a common child, a child of the claimant or of the defendant; (f) gender based violence; (g) de facto separation for a period of at least two years; (h) non-cohabitation for more than six consecutive months from the date of celebration of marriage without valid grounds; (i) if the cohabitation becomes impossible due to irreconcilable differences of one of the spouses. These provisions aim to protect spouses and ensure fairness in dissolving unions that can no longer be sustained. Divorce laws in Rwanda reflect evolving societal values and aim to balance individual rights with family stability. Subramanian (2024 INSC 1033) addressed the complexities of marital disputes, granting a divorce on grounds of mental cruelty, desertion, and irretrievable breakdown of marriage. This judgment not only redefines key aspects of matrimonial law but also emphasizes financial justice by awarding ₹1 crore in alimony. Key Insights from the Ruling: Mental Cruelty Redefined: False allegations of dowry harassment, neglect, and prolonged separation were held to constitute mental cruelty. Citing Samar Ghosh v. Jaya Ghosh, the court reiterated that sustained emotional anguish is equally damaging as physical abuse, rendering cohabitation intolerable. Irretrievable Breakdown Recognized: While not a statutory ground for divorce, the court acknowledged that 20 years of separation rendered the marriage beyond repair. Forced continuation of such a “dead marriage” would serve no purpose but to prolong suffering, aligning with Naveen Kohli v. Neelu Kohli. The Long Road to Divorce in India, mental harassments. Yesterday, I had the opportunity to visit the Rohini family courts for a divorce case, and it was an eye-opening experience the disappointed families and kid's future. The reality that it takes more than 2-3 years to dissolve a marriage in India is deeply concerning. Impact on Lives: The prolonged process not only prolongs the emotional and psychological turmoil for the married couple but also creates significant financial strain. Both parties are often left in a state of uncertainty, unable to move forward with their lives during this extended period. A Call for Change: It’s clear that the judicial process needs to be more efficient to reduce the burden on those seeking to dissolve their marriages due to conflict or where there is no possibility to continue the marriage. Streamlining these procedures and exploring alternative dispute resolution mechanisms could offer a more humane and efficient way to handle divorce cases.
