#strata conundrum no. 4 So far this morning I’ve heard owners protest the paying of levies and then debt recovery activities for overdue arrears; AND I’ve heard committee members frustrated that the time to get orders via VCAT and/or the courts takes too long and people need to pay their share? I was in a meeting a while ago having to raise a special levy while there is one owner, quite well off but refusing to pay his levy. Being the most vocal in the room he thought he had me when he asked "The quote is for $120,000, why are your raising $150,000. Then he went on his soap box on how we rip owners off. My answer of "Äs the owner who hasn't paid the last 2 quarters of levies, we can not guarantee you will be paying this special levy on time, so the other owners need to subsidise your non payment." He got a little embarrassed as the other owners were asking about his financial stability etc so he promised to pay all debts and special levy by the end of the week.... which he did. I call that a nice win. I do agree however that the debt collection process is cumbersome and does take quite some time to get a resolution.
Just had a serial debtor for the past 10 years cleared his debt last year. Now he is citing financial hardship (no evidence or supporting documents) and can only afford to pay $10 a fortnight. Pretty sure he still works in the big 4 according to LinkedIn. I told him to sell if he can't afford it. Yes, I get the how dare you.....:)
"We are all equals but some of us are more equals than others" Animal Farm special levies implies contractors- contractors implies builder's lien----> they may place that lien on 1 or all of the owners of a Strata--- A special levy once approved becomes automatically due and if any one or refuse pay- issue a demand for payment with a deadline--deadline not met-- you are in a legal position to lien them. the more vocal ones who object to everything will be the first one to back down when you call their bluff. pride cometh before a fall and no one and I mean no one wants a lien put on them.
