Michigan is one of six battleground states that could determine the winner of the presidential election. The auto industry has long been at the center of the state’s economic prospects, propelling the middle class through much of the 20th century, before shedding jobs and pushing down living standards in more recent decades. Today, the fortunes of Michigan’s auto industry revolve around a key variable: Is the shift to electric vehicles a fresh source of dynamism and paychecks, or the latest reason to fret about the fate of American factory workers? Donald J. Trump has made inroads with autoworkers by accusing the White House of pursuing a “job-killing E.V. mandate.” Many of them dismiss electric vehicles as unwanted, unaffordable and impractical given the need to charge them. W2 vs. 1099 has always been a debate for business owners. The battle is getting even more heated! A federal district court judge dismissed the California Trucking Association’s case against the application of AB 5 and the ABC worker classification test to the trucking industry. (California Trucking Association v. Bonta (March 15, 2024) U.S. Dist. Ct., Southern Dist. of Calif., Case No. 3:18-cv-02458-BEN-DEB) This means that interstate truckers are subject to the ABC test and will likely be treated as employees of motor carrier companies rather than independent contractors unless one of the exemptions from the ABC test applies, such as the business-to-business exemption. Pushing back on a “‘California knows best’ economic philosophy," Boyden Gray PLLC has filed a lawsuit on behalf of the American Free Enterprise Chamber of Commerce and Associated Equipment Distributors challenging an illegal California rule that seeks to ban heavy-duty internal-combustion trucks and vans. The California Air Resources Board’s (CARB) “Advanced Clean Fleets” (ACF) plan orders disfavored fleets with vehicles that cross into California or service the state’s ports and railyards to discard their internal-combustion vehicles and buy expensive, heavy, and low-range trucks that use batteries instead. Through ACF, CARB is effectively requiring many out-of-state fleet owners and operators to replace their working internal-combustion vehicles with some 570,000 alternative powertrain trucks by 2045 (and by 2035 for drayage fleets), up from virtually zero today. The lawsuit contends: “That transition won’t happen on the vast scale imagined by CARB. But the scramble to comply with a plan that defies the laws of physics, chemistry, and economics will be remarkably destructive.” https://lnkd.in/ebcpdewU
